Sources: the June 27 land auction in Phoenix already has 4 bidders registered including Meruelo. That means there will be at least 3 bidders against Meruelo, and maybe more as there is still plenty of time for others to register. Should be interesting.

Here is what my source has told me is fact: The Coyotes applied for the land auction several months ago. They wanted 200 acres. The appraisal came in too high for Yotes bank account. They cut application in half, to 100 acres. Land Department has to redo review.

According to ASLD press release, Meruelo first has to obtain a special use permit allowing an arena to be built on the land BEFORE he can be permitted to buy the land. A total fuckup, again, by the AM crew who seem to have misinterpreted the existing zoning restrictions.

Unless there is some kind of written commitment Meruelo has made, there is nothing in NHL Constitution or by laws or standard Consent Agreement that requires an arena to be of a certain size. Mullet conforms with CBA requirements. Team is cash flow positive at Mullet last year.

100 acres for arena? Massive Tempe project was less than 50 acres. Could this be the same strategy as Senators tried? Build arena in 1/4 of land, and then the rest of the land rockets up in value? Arena development now is all about real estate development.

So…..not only do they need a change in zoning to allow a massive arena to be built, but also City of PHX has gone on record as being opposed to designating the land as a ‘theme park’ which would allow for property tax abatements.

I have no doubt the NHL would be fine funding post retirement health care as long as it counts as Player Compensation. Query whether current players would agree to fund additional retirement benefits beyond pension

“ You still have a better chance than you think”….all I meant was that I was involved in a team purchase in 2006 where NHL (as was their right) changed the terms of the BoG consent 2 days before closing and the transaction was cancelled. Apologies.

@FriedgeHNIC The Cap this coming season is 83.5. However, Regardless of how high HRR goes (even if it hits $10 billion) the NHL has the right to limit the salary cap for the following two seasons to $87.675 in 24/25 and to $92.05875 in 25/26. Then it’s CBA renegotiation time!! Ouch!

@dustin_kersey @walsha No Dustin.....they can get rid of it by voting to decertify the union as the sole bargaining agent of the Players, and instead negotiate their own contract with the advice of their agent(s). Collective bargaining system now helps owners more than players.

@TimingChalk With a proper arena in a proper location I think the Yotes would be fine. 96 to 02 at Footprint was fine for what it was. Franchise has been doomed since 2003 when they went to GDale instead of Los Arcos. Retail business. Location, location, location.

@TSNSimmer Two things. First, 1/2 of capital gains is included as income for tax purposes. So mid 20’s is the max, depending on provincial jurisdiction. Also a complicating factor here is the non residency status of one or both beneficiaries. Second, you can borrow up to 50%, not 30%.

@theazsportsguy @andyblackledge Hockey is a retail business. Location, location, location. Footprint was never a good hockey venue. Glendale (instead of Los Arcos) and Mullett were horrible venues. And aside from the very first owner, ownership has been awful. NHL can work well in PHX.

A team failing to report ‘shareable revenue’? I’m shocked!! NHL Players should read the article and take note. Reported HRR is lower than actual revenue. NHL is very good at hiding revenue from the NHLPA that should be included in HRR. Pay attention to what’s going on!

Smith very carefully, and likely at league direction, never mentioned relocation. Only expansion. NHL conducts extremely comprehensive financial due diligence. On every proposed owner, including minority owners. And due diligence on all other operating issues, and

@BillShaikin Bill, I just reviewed Manfred's quote. What he means is that MLB will arrange broadcast of games in local markets where Sinclair has 'rejected' the existing broadcast agreement. The games will be made available for fans, but likely with little or no 'rights fees' for the teams.

@Proteautype NHL Players will be paying 50% of the 'rights fee' amounts not paid by Bally to NHL. That's the beauty of the triple hard cap for Gary. Players share risks of ownership....like bad debts....but not the rewards, like franchise value increases. Who agreed to this CBA anyway??

@frank_seravalli Also interesting is that Gary cannot unilaterally 'declare' a Circumvention. Only a System Arbitrator can make that ruling....see CBA 26.13(b). Also anything 'Permitted' by the CBA "cannot be a Circumvention".. see last sentence of Article 26 Preamble.

@LostJoshPython @walsha I would say anyone ‘not in the business’ doesn’t know the CBA, as amended, is on the PA website, as a matter of public record. it’s a very complex agreement, so the key is not just reading it, but understanding/interpreting it in a way that can give your team an unintended edge.

@reporterchris The reality is, if I’m an owner, I am far from convinced there is a business case for Olympic participation. There are pros and cons, but the pros do not exceed the cons. Players want it, fans want it. But how does it increase revenue, or the value of my franchise??

@StuCowan1 Well Stu. A new arena plan that is acceptable to the NHL is not going to happen in time. IMHO the only thing Yotes owner is maneuvering for now is a good litigation position to fight over who gets how much of the ‘Relocation Fee’ when the team is sold. It’s a fascinating dance!

@walsha Simply stated, the 50/50 split of reported HRR is not the same thing as a 50/50 split of the economic benefits of owning a team. And HRR is underreported by the Clubs in large amounts, and finally team ownership provides a spectacular tax shelter even if a team makes money.

So now. With Smith’s declared interest only in an expansion team, Gary has the political/legal cover he needs to start the due diligence process in earnest without having to worry about accusations that he interferes with Meruelo’s attempts to get his arena deal done.

@walsha @ConcussionLF Gary ‘stepping down’ won’t make a difference. The NHLs legal strategy won’t change. However…..in the next CBA negotiations the players can make change in safety rules a bargaining issue and strike until they are satisfied with the result obtained. Really that’s the only way.

This may be (may be, not is!) covered by the General Anti Avoidance Rules in the Income Tax Act, despite the Tax Treaty.

There is no chance the bond issue will be successful because 1) no private investor in his right mind will buy without credit enhancement or guarantee by City Tempe as well as settlement of the flight path issue 2) institutional investors cannot legally buy these ‘unrated’ bonds
