I don't want to pick on Michelle but I never understood people super worried about telegraphing their theory of the case. The point of Discovery is to do exactly that, so that you can present a clear and concise explanation of why you win.
Another reason why attempts at “gotcha” moments are generally a bad idea in depositions: you reveal way too much about your theory of the case. The lawyer the past two days didn’t get any useful testimony but sure showed us a ton of his cards.

He's probably right that the supreme Court wouldn't give Biden immunity, but that's because the supreme Court wasn't creating a rule that applied to anyone other than Trump.
This is unacceptable, although it's my understanding this was done by non students, and supporters of Palestinian rights need to make sure they condemn this behavior and distance themselves from it.

The reason biglaw can be like this is in part because clients don't punish their lawyers for acting like this. It would be nice if clients, finding out their lawyer was abusing their staff, would fire their lawyer, giving rainmakers an incentive to be decent people.

The judge assigned to the US the Apple antitrust case has been recused. He has a conflict of interest because of owning Apple stock. The new judge is Judge Julien Xavier Neals, appointed by Biden. I don’t think he has any antitrust experience.

Wow! Sens. Roger Marshall (R-KS) and Marsha Blackburn (R-TN) have introduced a bill that would designate student protesters "Terrorists" and add them to the "No Fly List" (with zero judicial oversight) for protesting Israel, which is deemed "violence against the Jewish people"!
It used to be the general rule that if you sued the Government over an illegal policy, it would have to change the policy in order to moot the case. If the Government wins this case, that would change to "we just need to promise not to apply the policy to you for the time being."
