Beware of any legal analyst who conveniently thinks the outcome of every case should be consistent with his or her own policy preferences.
If you don't think some laws you hate should be upheld, and some you like invalidated, you're not doing law.
In these dark hours, tonight the colours of the Ukrainian flag shine bright on the
@EU_Commission
headquarters.
A symbol of our solidarity. Friendship. And steadfast support.
More than ever, the EU stands with Ukraine and its people.
This is a terrible argument for student loan forgiveness. Why would someone who didn't go to college be moved to pay off the debt of a sitting congresswoman with a law degree?
Rep.
@RashidaTlaib
: "I worked full time, Monday through Friday, and took weekend classes to get my law degree. And still, close to $200,000 in debt. And I still owe over $70,000 and most of it was interest."
A pretty extraordinary moment: Solicitor General Prelogar points out that men are wildly overrepresented among the Supreme Court bar, and that this "gross disparity" could signal to women that becoming a Supreme Court litigator is not "a path that's open to me."
We were outside the Capitol for 5 days. Rain. Heat. Cold.
If they think this partisan ruling is going to stop us from fighting to keep people housed, they’re wrong.
Congress needs to act immediately. For every unhoused or soon to be unhoused person in our districts.
Clarence Thomas hasn't changed his ideology since about 1973. The idea that he's voting a certain way because that's what Harlan Crow or whoever wants is actually offensive.
I think it’s true that Justice Thomas’ bribes are for general ideological fealty rather than case-by-case piecework but I’m not sure that makes me feel better about it.
Tucker Carlson: “The city of Moscow…It’s so much nicer than any city in my country…It’s so much cleaner, and safer, and prettier -esthetically-…Than any city in the United States.”
Rep. Jeffries: "What evidence do you have to support" that Dems hate Clarence Thomas because he's a black conservative?
“The Chairman of this committee called him an Uncle Tom.”
Rep. Jeffries: “He has freedom of speech.”
"Can I give you another example."
Rep. Jeffries: "No."
Doocy on Brett Kavanaugh being forced out of a DC restaurant by protesters: "So these Justices, because protesters do not agree with an opinion... have no right to privacy?"
Jean-Pierre: "This is what a democracy is."
Javier Milei continues his fascist rampage in Argentina.
He has authorised the Privatising of all remaining State owned industries (thats his donors cashing in).
He has also authorised the sale of all Social Housing and removed all rent controls
It is going exactly as expected
If we expand the Supreme Court so that President Biden can appoint four new justices, we will protect Roe v. Wade and undo the damage that Donald Trump and Mitch McConnell have done to our nation's highest court.
Of course Purdue is very good again and nobody saw it coming. Matt Painter keeps getting criminally underrecruited kids from winning Indiana high school programs. It works.
Why would a university be constitutionally prohibited from having a legacy preference?
This just shows how many people view these big cases as mere policy disputes. It doesn't matter if SCOTUS likes legacy admits, there's nothing remotely constitutionally suspect about them.
Fun fact, Amy Coney Barrett’s daughter is a legacy admissions student at Notre Dame… So, if you are wondering if SCOTUS will find legacy admissions unconstitutional…the answer is, no.
Oh no, RIP Buddy.
He was a great guy. In retirement he ran a baseball camp in Huntington for many years, which I attended more than once. Here's me with him circa 1995
"Five justices can direct the destiny of the nation as they choose, without having to worry about reciprocation, because they can decide how legal principles are applied, or, if they choose, simply throw them out and invent new ones." From

There are surely many Muslim bakers who didn't want to bake a custom cake for a same sex wedding. But they didn't get hauled into court twice.
I wonder why that is?
Yes I'm sure Amy Barrett was anticipating being on the Supreme Court and that's why she adopted two children from Haiti while she was just a law professor. Makes total sense.
Man these people are the worst.
I'm not even going to focus on the obvious point about originalism.
WHY DO SO MANY PEOPLE NOT KNOW THAT IT WAS THE STATES WITH MORE SLAVES THAT WANTED TO COUNT SLAVES AS PERSONS SO THEY'D HAVE MORE ELECTORS AND SEATS IN THE HOUSE?!?!
I want to make it clear that I don't endorse Joe Biden. But I will be voting for him in November. I wrote in candidates the last two elections, but after Trump's dangerous behavior in his attempt to steal the last election, he cannot be allowed to return to power.
I talked to the dad of a junior Marine officer a couple of days ago. Told me his son got the jab against his wishes because he worries the net effect of the mandates is to turn the military woke. He wanted to stay and fight back.
Institutional Dem support for race based admissions is perhaps the clearest example of how the party has been captured by a small group of highly-educated progressives who live in a very thick bubble.
You'd hardly know 70% of Americans support today's outcome.
Paying an employee less for the same work because of sex has been illegal in this country since 1963. If that is happening to you, by all means file a lawsuit.
But the "pay gap" has nothing to do with that.
@HannahDCox
Most people with kids (including me) probably think this comes off just extremely weird. I would think working women without kids would be more offended because she acts like if you don't have kids you can just get high and sleep until 1230.
Vaccination alone won't stop the rise of variants and in fact could push the evolution of strains that evade their protection, researchers warned.
They said people need to wear masks and take other preventative steps until almost everyone is vaccinated.
One thing I like about appellate litigation is it often seems more collegial. After our telephonic argument in the Second Circuit, opposing counsel sent me a nice email saying he thought I'd done well. Just makes you feel better about the whole experience.

Socialism and communism are responsible for more human suffering than any other ideology in the past century.
Capitalism has lifted billions out of poverty and created unimaginable wealth and innovation.
So, yes.
Rep. Alexandria Ocasio-Cortez rants about how babies in the womb are not a life.
"Oh… you’re harming a life, I believe this is life," she says mockingly.
Conservatives love nothing more than to be both victor and victim. Just utterly addicted to whining even with a dubiously obtained 6-3 majority and Roe about to fall.
Guys I'm making a big concession. I'd be totally fine in a country where power fluctuated between a center-right coalition led by Mike Pence and a center-left coalition led by Mitt Romney.
However much I like and respect
@GovLarryHogan
, this argument doesn’t fly. If voters are concerned that a GOP majority would be inclined to do “crazy things,” why should they vote for anyone whose election could help create such a majority?
Vance has literally never been popular. He won the primary with 32% of the vote even with Trump's endorsement. Then ran far behind normie republicans in the general.
The other telling nugget in this poll: JD VANCE fav/unfav in this Trump-won Ohio-09 district: 43/48.
This in a blue-collar district in Vance's home state. Big sign that the Vance veep pick is politically backfiring for Trump.
Ah yes, everyone knows the winner of Loving County, Texas (population: 94) receives just as many votes as the winner of Los Angeles County.
Or something.

@SenSchumer
: "Until 1981, this powerful body, the Supreme Court, was all White men. Imagine. America wasn't all White men in 1981, or ever. Under President Biden and this Senate majority, we're taking historic steps to make the courts look more like the country they serve."
Earlier today Corey DeAngelis, a far-right advocate of school privatization (complete privatization) was attacking unions for being anti-science.
Why, because as the CDC met with stakeholders about how to open schools, unions suggested two changes the CDC accepted.
Uhh yeah, pretty much every salaried employee is expected to work outside work hours. And many don't get summer break, spring break, fall break, federal holidays, etc., off.
Barrett is now likely to become the first Supreme Court nominee in modern history not to receive any "yea" votes from the opposition party.
Here are how many opposition party "yea" votes recent nominees received:
Actually we're pretty thrilled about the brief. We want Americans...all Americans...to be secure in their Second Amendment rights.
This is some major projection from Elie, unsurprisingly.
Gun Nuts reading this brief: "Hells yeah. We need guns everywhere. These people going after New York are... wait a minute.. is that there one them 'black' persons? What even is 'Malcolm x Blvd' is that a street? Oh God, this is ALL black people who want GUNS. We cain't have this"

The Court's opinion in the Trump immunity case strikes me as eminently reasonable. I have a hard time believing that many of the hyperbolic tweeters of the day read past the headline.
Under this "theory" (really charitable to call it a theory), is the

student from a top 30-35-ish school really NEVER good enough for a SCOTUS clerkship?
The person "calling for war" is Vlad. You know, the guy Tucker is buddies with now?
The rest of us want peace but we can't have it because Vlad wants war.
Hope this helps.
Tucker Carlson calls out Nikki Haley, Ben Shapiro, and every other person calling for war:
"I've got 4 draft-age children. If you're playing recklessly, fast and loose with their lives, then I have a right to despise you and I do."
Just met a couple IRL in the American West who told me they are seriously considering moving to Far East Russia. They knew all the details, had plans, everything.
I can't imagine they're alone. Time will tell. You can call me crazy, but frankly, I'm bullish on the whole thing.
@henryolsenEPPC
Never stop and think whether they can’t make the exact same argument when the US send its troops and missiles to their doorstep. You start with the assumption you’re the good guys and they’re the bad guys, everything gets understood through that lens.
Sitting United States Senator with a law degree from a top 25 school admits he has no understanding of a basic theory of constitutional interpretation, would rather spout off random scare words.
“As long as it takes” is not a real answer.
Biden is really trying to commit us to an indefinite war. Time for Republicans to stand together and say “no.”
Biden just now: "I'm asking every House member, member of the House of Representatives, to vote yes on both these bills, right now. Send the infrastructure bill to my desk. Send the Build Back Better bill to the Senate."
"Let's show the world America's democracy can deliver."
So I assume Kari Lake will declare her own nomination fraudulent, since, you know, she only took the lead after all the fake ballots were counted, or something.
Oh, is that not how this works?
Trump says Putin's military move on Ukraine is "genius."
"Putin is now saying, 'It’s independent,' a large section of Ukraine. I said, 'How smart is that?' And he’s gonna go in and be a peacekeeper... We could use that on our southern border."
"Here’s a guy who’s very savvy."
My mom is in the hospital and tested postive for COVID. I was able to talk to her tonight and she seems okay, but certainly thoughts and prayers for her are appreciated.
Stephen Breyer says the U.S. is "an experiment that's still going on," based on its Constitution and founding principles
"My grandchildren and their children, they'll determine whether the experiment still works. And of course, I am an optimist, and I'm pretty sure it will."
It is really amazing how progressives have memory-holed the fact that Bush v. Gore was a challenge...BY AL GORE...to the results in Florida. By stopping the recount, the Supreme Court did not "pick the president," but directed that Florida's choice be respected.
This article from
@rickhasen
about Moore v. Harper in
@Slate
is very good.
Basically, Roberts has now codified Bush v. Gore. And while that means that red state legislatures cannot pick the President, the Supreme Court might... again.
Probably 98% or 99% of all humans who have lived on earth throughout history have lived in poverty. So yes, poverty is very naturally occurring.
Wealth is the exception, thanks to capitalism.
If only people knew the kind of rituals performed upon initiation into the Federalist Society. We are bound not to speak of them.
I mean wait, literally anyone can join by paying the dues.
Every time I read a tweet like this I'm reminded how many people will believe any claim, regardless of the evidence, so long as it furthers their ideological agenda.
Every time I read a Kavanaugh, Thomas, or a Kozinski opinion in law school without even a note, I'm reminded that that men do not suffer consequences for sexual harassment or assault in the legal profession. So, maybe help your law students trying to change that culture.
It is deeply disturbing that -- virtually everywhere -- the concerted litigation strategy of the GOP is to make sure that fewer votes count. The strategy goes far, far beyond any legitimate concern about fraud.
Uh yes, private platforms have a First Amendment right not to host your speech. How could they not? Is it now the conservative position that if we don't like a company, we can simply declare it the government and thus regulate it?
What is the point of funding education? Is it to educate kids or is it to prop up public schools? If it's the former, then obviously we should have vouchers. If it's the latter...what's the point?
I wonder how many SC teachers will leave the profession at the end of the year. Now legislators are sponsoring a voucher bill (S. 935) that will take public school money & give it to private schools. Public education and salaries are not even funded at the levels they should be!
My mom is in the hospital and tested postive for COVID. I was able to talk to her tonight and she seems okay, but certainly thoughts and prayers for her are appreciated.
