postscript: was the petition a good idea? idk man, how to approach a client’s appellate loss is a REALLY hard question for civil rights lawyers. I get why the ACLU petitioned, I get why people are upset. no easy calls when you rep an individual client who’s being hurt

I have complicated feelings around it … a lawyer represents an individual client and has ethical duties to them. Should you tell your client that they need to eat a loss, to devastating effect, because of a broader risk to the movement? Maybe, but it’s a very hard call
