Those laws can be created, and it's even a settled legal principle that an unconstitutional law is as null and void as if it had never been enacted. The dividing line between "should" and "is" is a court ruling that the law is unconstitutional. Until then, the law is valid.

I believe in the right of private citizens to own guns precisely because I love people - more than criminals or mass killers who want to destroy them.
Getting rid of guns would not stop mass killings, even if it was possible.
