Yes, U.S. history. While it rivals the DC handgun ban that was overturned with the SCOTUS Heller decision, SB25-003 will ban nearly every semi auto rifle and shotgun that take detachable magazines and some pistols. It is worse than the DC handgun ban. There are a number of compelling reasons why SB25-003 represents legislative malpractice and why it should be rejected outright. I will share them on this thread. While this analysis is detailed, it reflects thorough research and careful consideration of the bill's implications. So far, the only argument Iโve seen from #coleg democrats that SB25-003 is constitutional is the age old โyou canโt yell fire in a crowded theaterโ. Iโll debunk that and explain why they need to provide arguments that SB25-003 is constitutional. #copolitics The โcanโt yell fire in a theaterโ clichรฉ is a complete misinterpretation of the law. The phrase comes from Schenck v. United States (1919), a case that was later overturned. The current legal standard for restricting speech, or any constitutional right, is strict scrutiny, meaning the government must prove a compelling interest and that the restriction is narrowly tailored to achieve that interest without unnecessarily infringing on rights. SB25-003 needs to be defended under actual constitutional scrutiny, not a debunked soundbite. If SB25-003 sponsors believe itโs constitutional, they need to cite relevant case law and explain how it survives the necessary legal tests, particularly under the Bruen framework, not rely on a misquoted century-old ruling.
