I joined the Board of the BCCLA last month, but the events of the past 2 weeks have left me full of regret & anger & I resigned yesterday. Pls read the co-written statement below, which I share to take responsibility for my role & to publicly reiterate my support for Harsha Walia
The freedom to engage in lawful, peaceful assembly and protest is a fundamental Charter right - but there is no place for hateful, racist symbols and rhetoric on Parliament Hill, or anywhere in Canada. (1/3)
We are off on day of 2 of the

hearing. Encampment counsel Jackie Esmonde of
@CavalluzzoLLP
starts off by telling the court that attendees wearing keffiyehs have been subject to harassment abusive language in the courthouse (but not by court staff)
The fact that student activists are using skills learned during active shooter drills to effectively barricade classrooms against cops coming to arrest them is blowing my fucking mind
Time to make this Twitter official! I am super stoked to be joining
@WindsorLaw
as an Assistant Professor this July. Huge thanks to everyone who helped me get here; it definitely took a village.
Windsor Law welcomes four new exceptional scholars to our faculty: Irina Ceric, Vincent Wong and Mary Anne Vallianatos join in 2022 while Daniel Del Gobbo joins in 2023!
I see all your abandoned sourdough starters and knitting projects and raise you a pandemic humble brag: my track record of signing up for and then failing to attend webinars remains unfuckwithable

PhDs are trending because of Nate Silver's absurd tweet so this seems like a good moment to announce that I'm defending mine tomorrow and that I'm well aware that I know only marginally more than Jon Snow. Wish me luck, comrades
This interview with

TMX is now anticipated to cost $30.9-billion, more than quadrupling the $7.4-billion budgeted in 2017 (the year before the feds bought it). Oh and the world is on fire.
Some initial thoughts on the Quebec Superior Court's decision denying McGill an injunction ordering the dismantling of a Palestine Solidarity encampment...
Go ahead & hate me but it's really hard to read this as anything but gall. I've been annoyed by the RBG cult of personality for years (not least because she was terrible on Indigenous rights). She could & should have retired under Obama & there's no reason to pretend otherwise
Just days before Ginsburg's death, as her strength waned, she dictated this statement to her granddaughter:
"My most fervent wish is that I will not be replaced until a new president is installed."
This. And less importantly, almost every rally/demonstrate in Toronto is "unsanctioned" -- you do not need permits or permission to protest. As I'm sure Mayor Chow is well aware, assembly and expression are constitutional rights
You're aware that people are supporting Palestinian rights; the rights of Palestinian people who are compared to "human animals" and who are being indiscriminately murdered?
@MayorOliviaChow
you have no understanding of settler colonialism.
Ontario's Ministry of the Attorney General screened job applicants who had signed a pro-Palestine letter.
@KunalChaudhary_
reports that experts say the hiring policy is racist and a "flagrant disregard" for constitutional rights.
We are members of the legal profession in Canada concerned about the pervasive repression of speech on Palestinian liberation. Read our open letter signed by 350+ lawyers, legal workers and academics.
Think a pandemic will stop me from talking about injunctions? Wrong. The NSSC just ruled that Alton Gas did not adequately consult with the Sipekne'katik FN, esp re "the core issue of Aboriginal title and treaty rights", and quashed the company's permit
I and another lawyer,
@noahrossj
were turned away from the RCMP checkpoint on
#Wetsuweten
territory today. The pretext was that we lacked chains and a two-way radio, a “policy” that has been unevenly and arbitrarily applied.
The cognitive dissonance of bombing hospitals on Remembrance Day is just too much. I am the granddaughter of three anti-fascist partisans. I'm glad they're not here to see how we've squandered everything they fought for.
This is a gorgeous tribute to Jen Angel, one that really speaks to the unseen/unsung work and care that goes into social movements (it also includes a pic of Fucktooth I took on my living room floor — shoutout to all my fellow radical ephemera packrats)
Judge interrupts to note that all social progress happens because of protest, because a troublemaker disrupted the existing order (!). So when should a court intervene, where is the line?
I am neither the first nor the last to beg the NYT to stop using the term "Balkanization" generally but esp in the context of abortion rights. Abortion is legal throughout the Balkans so keep us out of your metaphors

The word "unauthorized" is doing a lot of heavy lifting here.
@YorkUniversity
is going to have to answer for its hasty invocation of the Trespass to Property Act. Looking forward to the arrestee's Charter application...
“A giant, well-enforced wall of laws and regulations has kept Indigenous peoples from hunting, fishing, fowling and gathering. Our traditional economies have been criminalized to maintain a non-Indigenous monopoly.”

I think I'm going to start my own patronage designation for lawyers. I will start awarding CCs (Comrade Counsel) to people I like who do good work as defined by me. Obvs, I'll award it to myself before opening it up for nominations.
Still haven't quite digested this astonishing

Foxgate Development’s permanent injunction in Caledonia has been cancelled while a $100K cost award against Williams has been overturned.

I taught a seminar on Civil Liberties this year. Five students -- a full fifth of the class -- wrote their research papers on the chilling/silencing of pro-Palestinian speech. Several students wavered before choosing their topics, worried about their employment prospects.
As a person who takes

#CovidIsntOver
Last night's raid at U of Calgary is a good reminder that the public/private status of universities and whether the Charter applies are not the real issues. Cops are always state action and rights of assembly and expression will not prevent or redress repression. What will?
Incredibly power advocacy here. U of T has an opportunity to use its power to help stop a genocide but it has refused, claiming that it needs to maintain 'neutrality'. Students used many tactics over 8 months to push for disclosure, divestment, and suspension.
So proud of UWindsor students! "We stand here in with solidarity students across the world calling for the same thing: our money and our education cannot and should not fund the death of Palestinians."

I tweet this every summer but jfc the air show is a horrifying anachronism that needs to end. This summer, more than ever, the screaming fighter jets above my head sound like nothing less than a celebration of climate catastrophe and endless war.
This is an incredible, visionary move by Carleton's ICCJ & judging by the pushback in my own department, it is one that will be need to widely defended & supported
The
@cbcnewsbc

I wrote to

Two big anniversaries today: 30 years since the start of the Mohawk blockade in Kanehsatake and Kahnawake and 25 years since the Srebrenica genocide in Bosnia. Both of these events shaped who I am in ways I'm still uncovering.

On Friday of the long weekend, the crown quietly dropped all charges against four of the so-called Indigo 11 because there was no reasonable prospect of conviction. I spoke to one of them and a lawyer for the other who plan to address the public today.
Esmonde also notes up front that the language in the injunction order U of T originally proposed would impact *any* protest anywhere on campus or adjoining public property without the university's permission. Inconvenience and discomfort do not outweigh the right to protest.
In its latest statement
@mcgillu
advises the encampment has tripled & that many, if not the majority are not from McGill. It also condemns the unequivocally antisemitic language & intimidation occurring. McGill leadership is meeting now on next steps. I hope for swift action.

I remember watching this live with my (Croatian) grandmother. She was very critical of this bald singer I liked so much until this happened and then became an instant, diehard fan.

McGill beaten to the injunction gate by two students. I'm sure enforcing any order will go smoothly and will absolutely not catalyze shows of solidarity and support...
It appears that the total number of

arrests is 127 (details in next tweet). This is not including the 29 arrests on

territory during the enforcement of the CGL injunction. There were 16 arrests at two actions in late January.
The university's submission yesterday that the encampment's zero tolerance policy is exclusionary is surprising, given that it is consistent with U of T's own hate speech policy.
