A huge victory for LGBT couples fighting for the right to marry in Japan.
Provisions in the Civil Code that do not recognize same-sex marriages are "unconstitutional" - first high court ruling from the Sapporo High Court
Japan’s approval rate for same-sex marriage ranks in the top 10 worldwide yet the Japanese government has taken no steps to legalize marriage equality.
Many Japanese Youtubers pretend that they are international/ open-minded until the issue of immigration is brought up. Then, they say that Japan is "too unique", "increasing immigration will cause too many problems", and "foreigners cannot understand Japanese culture".
Carolina Shiino, a naturalized Japanese citizen who was born in Ukraine and has lived in Japan since she was 5 years old, won the 56th annual Miss Japan pageant yesterday.
This is correct. The “Japan does no wrong” crowd is ignoring that most Japanese skip out on paying pension, insurance, etc sometimes. Many foreigners also work for black companies like eikaiwa who say they are paying taxes for you but then pocket the $.
Japanese people themselves often skip out on paying pension, insurance, etc. Plenty of politicians have been caught doing that.
To even get PR, one has to be responsible with their taxes
Plus, things were a MESS during COVID with people losing their jobs, etc.
I once had a Japanese colleague tell me the way to solve the population crisis in Japan is to force all Japanese citizens living overseas to return & live in Japan.
Crazy.
I firmly believe Japan will collapse if they don’t embrace multiculturalism & accept foreigners.
"Japan is the only G7 country not to fully recognise same-sex couples or offer them clear legal protection, leaving the country's LGBTQ+ community feeling vulnerable and nearly invisible."
@writerofscratch
My husband grew up in this city. It’s a very progressive city compared to the rest of Japan. We have several friends who spoke 3+ languages but couldn’t get municipal government jobs bc they were Brazilian. This proposal is excellent and hopefully the rest of Japan will follow!
Sometimes foreigners get huge tax bills & don’t know why until the ward office tells us that our companies were not, in fact, paying our taxes and had been lying for an entire year. This will hit eikaiwa workers, poor workers with PR, etc. It’s not going to be enforced fairly.
When I worked as a teacher in a small Eikawa in Japan, my Japanese boss found out I was gay. She told me “no one wants a gay teacher” and often made homophonic comments. I changed to a different school managed by westerners. My new managers were accepting.
@BassBrendanish
I have many Japanese students who want to learn about other countries/ cultures. They unknowingly make racist/ xenophobic comments sometimes. They admit that there is little multicultural education in Japan. There’s also very little political engagement, which makes change hard.
I don’t think Kishida understands that in order to realize a “society that values LGBT+ equality”, the government actually has to pass same-sex marriage and anti-discrimination laws. Does he think if he repeats meaningless words over and over society will just believe him?
@mrshobutt
It always amazes me how much abuse Japanese companies make their workers endure. I’m equally amazed/ depressed by the large number of Japanese workers who take the abuse and don’t complain….
This is very interesting.
Izumi Kenta, leader of the CDPJ, mentioned today the possibility of some kind of alliance with Ishin no Kai to achieve a new government without the LDP.
BREAKING NEWS: In a landmark decision, the Supreme Court on Wednesday ruled as “unconstitutional” a clause in domestic law that requires transgender people to undergo sterilization surgery to change their gender assigned at birth in their family registry.
Unless the Supreme Court rules in favor of same-sex marriage or the LDP loses an election, same-sex marriage in Japan will take decades, regardless of the LDP’s occasional “LGBT understanding” rhetoric. The party is still controlled by bigoted, corrupt religious cults.
Good news today for same-sex couples seeking to marry in Japan. The Tokyo District Court has ruled that current provisions not recognizing same-sex marriage are in an unconstitutional state.
The Sapporo High Court will rule today on same-sex marriage at 15:00 (Japan Time)
It’s the year 2050. The Japanese economy has collapsed, the birth rate continues to plummet, social problems remain unresolved, and Japan’s public programs can no longer function.
50%+ of Japanese voters: “We have to vote for the LDP bc other parties will mess everything up.”
Japan: 71% of the public favors same-sex marriage. 72% opposes abolition of health insurance cards.
LDP: Marriage equality will not happen. We will abolish health insurance cards.
The LDP doesn’t care what the public wants. Why do the Japanese people continue to support them?
Nishimura Yasutoshi, touted as a potential PM, is on the far-right of the party and an opponent of LGBT rights. Now, he’s in legal trouble bc of the slush fund scandal and his former colleagues are leaking unflattering stories about him to the media.
Things aren't looking great for Nishimura Yasutoshi, who recently stepped down as trade minister over illegal slush fund allegations. Now tabloids running articles about his "black bikini secretary" with whom he allegedly booked connected hotel rooms.
Many eikaiwa are in trouble due to the growth of online English schools. Managers don’t understand the way to stay in business is to make their teachers happy so they will stay & teach quality classes. This new policy from GABA will put the school out of business faster.
Add ¥5000 if you fail to notify the company - so if you are hit by a truck don’t forget to call in to let them know you won’t be in to work that day.
GABA says they need to do this to cover administrative costs - phone calls to clients etc. LOL
I honestly believe the Japanese LGBT community should focus on organizing politically against the LDP. Hoping the LDP will change its position is a political dead end.
Included in the Sapporo High Court’s ruling is a violation of Article 24, Paragraph 1 of the Constitution!!
This is the first high court ruling & it clearly states that forbidding same-sex marriage is unconstitutional.
Kishida & LDP- Pass 👏 marriage equality 👏 now!!! 👏
“Although the Japanese left claims that Nippon Ishin’s policy orientation is even more distant than the LDP’s, on the most contentious social issues Ishin aligns with their positions.”
Polls put support for same-sex marriage in Japan between 65%-83%. The sooner Kishida ignores these fringe right-wing lawmakers, the more popular he will become.
Conservative LDP asshole MPs are fuming after yesterdays ruling on same-sex marriage, some saying that their voters will leave the party if they support same-sex marriage.
Even if Kono becomes PM, I’m skeptical he could pass same-sex marriage. The reason is too many MPs in the party have maintained their ties to religious cults, despite public outcry.
Video: Upper House lawmaker Kamiya Sōhei of the fringe right-wing populist party Sanseito denounces Japanese people who choose to work for foreign-owned companies, saying it hurts Japanese companies and the Japanese nation.
Yoshiki Yamaura, a former Supreme Court Justice, supports the same-sex marriage lawsuits in Japan. He stated that it is difficult to predict the final outcome of the litigation, but that Japan "has to change now".
@kouzou1982
It’s so true. Many of my Japanese friends have left Japan to be with their partners. I recently rejected a job offer in Japan because my husband and I didn’t want to live in a country without marriage equality. It’s hurting the Japanese labor market.
^ The BBC is giving Kishida too much credit. Kishida is doing nothing to help LGBT couples in Japan. He keeps saying that he wants to "create an inclusive society", but refuses to pass marriage equality and/or discrimination protections.
@tomkXY
Congratulations!!
I don’t know much about your circumstances, but in my case, once I left Japan my mental and physical health improved immensely. The same goes for all of my foreign friends who left Japan.
Wishing you and your family the best!
@Bennet87AO3
Yes lol. Their attitude is "We get to live here, but let's make it harder for everyone else to come."
They also refuse to see anything wrong with Japanese society and ruthlessly criticize those of us who point out Japan's flaws.
This is completely inhumane.
Other developed countries need to do more to condemn Japan’s lack of LGBT rights.
This is an example of why my husband and I refuse to live in Japan until same-sex marriage is realized.
My deepest condolences to Kondo Kei for her loss.
Kondo Kei lost her partner, Imai Miari, when they were struck by a crane car. Kondo wanted to testify at Imai's accidental death trial this month. Despite being legally wed under their local partnership system, however, the Japanese court refused to recognize Kondo as family.
My husband and I are thankful to live in a country where elected leaders support our rights.
America has a lot of problems, but we appreciate my country’s desire to move forward and not remain stuck in the past on issues like marriage equality/ LGBT rights.
Happy Pride!
Pride Month has always been a joy-filled celebration. While we celebrate how far we’ve come, we must continue standing in solidarity with LGBTQ+ Americans in their ongoing struggle against discrimination and injustice.
Of course this is just one case. 65% of Japanese people support marriage equality. That being said, it is true that being openly LGBT in Japan can have a bad impact on your career. This can account for why so few LGBT people in Japan are open in their workplace.
This is not a ”I hate Japan” tweet. My husband and I want to return to be near his family in Japan one day. I wish for Japan to have strong political leadership who will promote LGBT rights. One day, LGBT people in Japan will be able to live openly without a fear of prejudice.
A pretty overwhelming and earth-shaking victory in favor of marriage equality today. On June 8th, the Fukuoka court will decide. If this Court rules like the courts in Sapporo and Nagoya, it will be pretty difficult for the LDP to delay passing same-sex marriage.
Condemnation from the international community is needed.
In cases of gender equality, representation, LGBT rights, and discrimination issues in Japan, the international community is too quiet. International outcry led to the 2023 LGBT Understanding Bill in Japan.
Again, this is happening in 2023. Japan’s government deserves condemnation from other G7 countries. I hope that the media coverage will become increasingly critical of Japan’s stance on LGBT rights.
Sometimes, my husband and I miss living in Japan. We go back and forth between wanting to return and remembering the frustration we had to deal with because I was unable to obtain a marriage visa.
Treat teachers like shit and your school will fail. Eikaiwa managers can’t understand this. It’s rare to find a teacher at an eikaiwa who has worked there for more than 1-2 years these days. This new policy from GABA will doom the school.
Add ¥5000 if you fail to notify the company - so if you are hit by a truck don’t forget to call in to let them know you won’t be in to work that day.
GABA says they need to do this to cover administrative costs - phone calls to clients etc. LOL
A shocking 45% of young people (ages 18-29) in Japan have suicidal thoughts per this report. Of this 45%, 40% said that they had attempted suicide or taken steps to harm themselves. This shows the immense mental health crisis plaguing the country.
How about choosing a leader or party who will reverse Japan's decline and address the country's social injustices? Whether the next PM is a man or woman, it's unlikely that they will reverse Japan's decline if they are from the LDP.
88-year-old man shoplifts a pack of eggs = Arrested/ sentenced to 1 year in prison
LDP lawmaker who received billions of yen in slush funds & evaded taxes = not arrested
Very happy to see other G7 countries condemning Japan’s treatment of LGBTQ+ people. Public shaming will push the LDP to legalize equal marriage and prohibit discrimination faster.
@YoheiSaiki
My Japanese husband was bullied & nearly committing suicide in high school because he was openly gay. After we met, we had to return to my country because Japan doesn’t have same-sex marriage. The LGBT law will raise awareness and will save lives. Hugs and support from the USA.
This is true. Living in Japan made me appreciate the American education system. The USA teaches critical thinking and helps students develop social skills/ mental health awareness. None of this happens in Japanese schools. Japanese education is just rote memorization.
I wish people actually praised the American education system because moving to Asia has really made me appreciate the critical thinking instilled in me from a young age.
The Nagoya and Fukuoka rulings will give us a better idea of which way the courts are leaning on the issue. It feels like yesterday when the Hokkaido court issued the first ruling. I’m truly hoping that Nagoya and Fukuoka will issue favorable decisions.
@bokuranoijyu
Several LGBT couples, including my husband and I, would like to return to Japan but cannot because our marriage is not recognized/ I cannot obtain a spouse visa. Not allowing same-sex marriage does result in the population declining because many couples have to live overseas
A xenophobic attack on foreigners with PR in Japan.
The Japanese government complains they need more foreign workers and then does this. Honestly, it just seems like an excuse to kick foreigners with PR out.
Japan 2023:
PM Kishida says a ban on same-sex marriage “is not discrimination”.
PM Secretary calls LGBT people “disgusting”/ says he “doesn’t want to live next to them”.
Upper House Lawmaker calls LGBT rights advocates “Marxists who are seeking to divide society”.
Tomonari Matsumura (LDP) has been criticized for his remark on LGBTQ+ education in schools, for saying, “Biased teaching materials and biased instructions may lead (students) to homosexuality.”
If you guys are curious, someone uploaded the whole GABA/Nova management AMA screenshots.
This was a fucking mess and they admitted to everything while being super racist.
Like. Super racist. 1/?
The ruling LDP is currently debating whether or not it is acceptable to discriminate against LGBT people. The LDP wants to include the term “unfair discrimination” in legislation. What is “fair discrimination”? Let this sink in.
First the Unification Church scandal and now the slush-fund scandal. Will the avalanche of scandals be enough to finally oust the LDP from power?
This is a huge development.
🚨HOLY SHIT
Kishida is kicking ALL the Abe-faction members out of his government:
Matsuno out as Chief Cabinet Secretary.
Nishimura out as Minister of Economy.
Hagiuda Koichi out as LDP Research Council Chair
Takagi Tsuyoshi as Diet Affairs Cmt. Chair
"Greece’s center-right government said Thursday [December 21] it would fulfill a commitment to legalize same-sex marriage, sidestepping staunch opposition from the country’s influential Orthodox Church."
Three foreigners in Tokyo and Aichi Prefectures are suing the Japanese government over claims of racial profiling, saying they’ve been stopped by police numerous times based solely on their appearance. One claims he’s been afraid to leave his home due to 20+ years of harassment.
The Nagoya ruling on same-sex marriage in Japan will be announced on May 30th. The Fukuoka ruling will be issued on June 8th. At the moment, only three rulings have been issued. One ruling in favor, one against, and one ruling which can be described as “mixed”.
@marriage4all_
makes a great point. Some court rulings have used the term “unconstitutional state”. The Sapporo High Court ruled forbidding same-sex marriage is outright “unconstitutional”- a much stronger decision for marriage equality!
As expected, Hagiuda, Matsuno, and other influential figures in the LDP are continuing to delay progress on marriage equality despite yesterday’s court ruling in Nagoya.
Japan: Might pass an LGBT bill that has no meaningful impact on the everyday lives of LGBT people.
Brazil: Refugees from countries that criminalize LGBT people will be given priority/ special protocol.
Brazil will be the first country in the world to adopt this type of policy.
@usagi_matto
I think you are vocalizing what a lot of people feel but won’t say out loud. When I lived there, I got similar comments from my colleagues. Now, pretty much all of them have also returned to their home countries (mostly for mental health/ discrimination reasons).
100% agree. Japan will eventually become a diverse & multicultural society, just like many other countries. Either that or their economy/ society will collapse because of their declining population.
Many Japanese people, including people I know, aren’t happy with the choice of Miss Japan. If people keep assessing Japaneseness based on roots and see only those with pure Japanese blood as their own, instead of embracing multiculturalism, Japan will run out of Japanese people.
@mattdeeeezy
It truly is. My husband and I were concerned about being separated if I lost my job, etc. We have lived in the USA since his visa was approved in 2019. We miss his family a lot, but the stress of living in a country without marriage equality made us decide not to go back.
HuffPost JP has the story of Kobayakawa Mari, who helped her female partner, Azumi Rina, run tack farm in Hatoyama, Saitama Prefecture. Mari says she never thought much about the rights conferred by marriage…until Rina died and the town suddenly treated her as a “stranger”.
GABA is making its English teachers register as “invoice-issuing businesses." This teacher told ANN that it will be difficult to pay off his mortgage and raise his kid if his monthly after-tax income becomes ¥131,516 ($881).
Takaichi Sanae, a leader of the far-right in the LDP, assures the public that the LDP is still a conservative party. The LDP has been criticized by right-wing voters for passing a weak LGBT bill earlier in the year.
Japanese politics is so depressing.
Under pressure from LDP conservatives, the wording of Japan's LGBT bill has been changed to say that only "unreasonable discrimination" is unacceptable. The opposition CDP has called it "legislation that creates the appearance of doing something, without really doing anything."
This is a devastating statistic.
Sadly, Japanese voters will keep voting for the LDP because they think “the other options are worse”.
I can’t imagine what is worse than having the highest relative poverty rate in the developing world.
Jiji reports that Takaichi’s failure to consolidate the conservatives behind one candidate in the Nara governor’s race calls into question her viability to reach the summit of LDP power. Without Abe, she’s not getting closer to the presidency.
PM Kishida affirmed his view that same-sex marriage would “change the traditional family and society” and that “the current environment is not in place for the realization of same-sex marriage”
Can Japan kick him out already???!!!
Thoughts on Japan's LGBT Understanding Law:
1) Any progress is good progress
2) This law is weak and deserves as much criticism as praise.
3) It was a struggle to get a weak law passed. It shows that Japan's LGBT community has a long fight ahead of them for marriage equality
Why?
1) They are controlled by religious cults who tell their followers to vote for the LDP.
2) They feel like they can do whatever they want and the public will still support them. (History has proven this)
This situation demonstrates the sad state of democracy in Japan.
When the Japanese gov't is offended, the other party must apologize immediately.
Yet, they look the other way whenever they are accused of rewriting history/ human rights violations.
The Constitutional Democratic Party’s Ishikawa Taiga, who is openly gay, asked Japan PM Kishida Fumio, “When will I be able to marry the person I love?” Kishida said it’ll be determined as “society’s understanding advances.”
A majority in Japan already support same sex marriage.
@usagi_matto
I felt the same way when I lived there. It’s privileged to tell someone they shouldn’t be resentful about living in a country that doesn’t recognize their rights. I wish that Japan received more condemnation for their discriminatory behavior towards minorities.
Husband and I are thinking of living in Japan again. 4 years after leaving, I worry that I am forgetting the level of stress that was put on us by the Japanese gov’t due to the lack of equal marriage. Seeing the stress of LGBT couples in Japan on here gives me reality check.
BREAKING: Mainichi reports that the Tokyo Public Prosecutors Office will likely give up on indicting senior Abe faction members, including ex-faction secretary-generals, as they have found it difficult to prove collusion with accountants (will be arrested).
Happy New Year!
2023 was a big year for LGBT+ rights in Japan. The Supreme Court ruled favorably on transgender rights, the government passed the LGBT Understanding Bill, and district courts ruled favorably on same-sex marriage.
Hopefully, the progress will continue in 2024!
