Two years ago today I watched a woman who had never been in trouble with the law before & who had video evidence of her innocence plead guilty to a felony she did not commit because she couldn't afford bail, had been in jail for a month, & just wanted to go home.
@ellearee
@msolurin
Hurt people tend to hurt people. He's mean to Max because of the trauma he's gone through. That doesn't make it okay, but if Who society wasn't shit, Max wouldn't become a victim either.
@msolurin
The only legitimately good Who in Whoville is Cindy Lou Who, everyone else sucks.
In the newest one, with Cumberbatch voicing Grinch, maybe we add Cindy Lou's mom & Kenan Thompson's character. But otherwise everyone else sucks. I fight this war in my family every Christmas.
This happens all the time & this case isn't particularly special in the grand scheme of things. But it was the first time I held in my hands a video that contradicted literally every claim the cops and prosecutors were making & showed it to a prosecutor just to hear "plea deal"
The prosecutor watched this video, saw the same evidence I did & refused to drop the charges. "she can plead to this lesser felony & go home today on probation, or we can go to trial & you can see if the jury agrees with you." Great, except, "go home today" always induces a plea.
Private prisons are bad & this is a good step in prison reform. However, don't get too excited. This only impacts federal prisoners and the vast majority of people in prison are there at the state level, this has no impact on those folks.
All the responses to this tweet trying to claim that Guyger shouldn't have been convicted of murder, only of manslaughter, are great examples of people giving their opinion without having read the Texas statutes defining murder & manslaughter.
Today’s verdict in Texas isn’t just an act of justice, it’s a correction to a culture that has sometimes allowed men and women in uniform to abide by a lower standard of behavior than applies to the average citizen of the United States:
@Popehat
"First we can't go into your house and shoot you? Now we can't shoot you without even going into your house!? What next, we just can't shoot people? How are we supposed to do our jobs!?!?!"
Police Unions, probably.
This is a good thing & a lot of people in the replies don't know what they're talking about.
In the old hot coffee case, that coffee gave that woman 3rd degree burns & required a skin graft to heal. This 4yo got 2nd degree burns. This is exactly what civil suits are for.
This is important & I feel like it is something too many people miss. It's a problem for many reasons, but notably it's a big problem when we talk about reducing prison sentences & people add the caveat of only releasing "non-violent offenders."
“Violent crime” is a legal term of art that rarely has anything to do with whether the crime or person was actually violent. So many people have been charged with “violent crimes” and labeled violent criminals when they harmed absolutely nobody
"How often do you think your family would be better off with you dead?" is actually a pretty important question. If your kid is having suicidal thoughts, mental health experts need to know that shit before the child actually acts on those thoughts.
I took my daughter to her yearly physical today (she’s still a minor) and the cheery nurse told her she will need a urine sample and oh since she’s over 15 they will need to get her cell phone number so they can call with any results and handed her the laptop to type it in. I
@msolurin
In response to this, she was suspended for 10 hours. No dock in pay, no announcement of an investigation into tickets she's given or arrests she's made. Just a 10 hour break. 🙄
Today in class I discussed with students the ridiculous amount of federal laws there are. I pulled out my copy of
@CrimeADay
's book, together we opened to a random page & found ourselves discussing how to identify "criminally sexual pork" & why one needs to identify it. 😂
Being inconvenienced in a traffic jam isn't tantamount to being kidnapped. These are not serious people.
Don't attack someone for protesting, even if that protest inconveniences you. Like, this shouldn't be that hard of a concept.
this is being framed as highly controversial, but the notion it's okay to kidnap hundreds or even thousands of people for five+ hours is far crazier. yes, when a terrorist takes a person hostage it is perfectly fine for them to fight back.
Almost all of my students know of Riker's Island as one of the worst (or best depending on the context they got their info from) prisons in the U.S. & it blows their minds every semester when I explain it's a pretrial detention facility. Just people that can't afford bail.
Few ppl know that Rikers is a PRE-TRIAL detention center. The ppl there have not been convicted of a crime, they’re awaiting trial, and they’re DYING waiting. Our mayor Eric Adams doesn’t care about them but I’d like you to hear from a mother mourning her son at a rally we held
If we're just throwing Stare Decisis to the wind, then may I suggest a few case that need to be overturned?
Cruikshank
The Slaughterhouse Cases.
Wickard v. Filburn
Qualified Immunity, Literally, just the whole concept.
Just those to start with. Yeah? Do it.
@msolurin
"Well, if I want people to show up two hours later, be absolutely no help at all, re-traumatize me, & then ultimately do nothing to bring actual justice about, I suppose I would call the cops." 🙄
@celestewhite
Except A. It's not up to the lawyer whether or not a plea deal is taken. & all the things you suggested take time. Days, weeks even. & the plea deal allowed her to go home that night. It was strictly her choice & she made up her mind as soon as she heard she could go home.
I'll add, we should absolutely be considering reducing sentences for people who actually committed violent crimes, too. Prison reform & justice reform more broadly require grace for all people, not just those that fit into a nice "victim of the system" picture.
@radleybalko
But haven't you heard!? We had a black president! Racism isn't a thing anymore. Something about bootstraps and pulling yourself up and "Don't blame me for my ancestors."
So I'm listening to Queen's Hope by
@ek_johnston
& Padmé notices a character singing "an unreasonably upbeat song about a family of predatory fish." And... guys. I love that Baby Shark is Star Wars canon. 😂🤣
@artemis_nieves
It makes me want to pull my hair out every time I see people claiming to be in favor of reform or fighting mass incarceration but only want to apply it the people that are, like, good little victims of the system. No consistency with a lot of these folks.
This is legit. People are complicated & nuanced. You can think someone holds a problematic position on a thing while still acknowledging that person is fighting the good fight in other aspects.
I think this is worth saying: Before you dismiss all the work someone’s done for their community, you should have to disclose what you’ve done because many have some nerve—don’t do zilch to service your communities but get online + discredit those who commit their lives to it.
@ConLawWarrior
"Democrats blame the gun for killings instead of murderers. That's like blaming the fork for you getting fat. ...oh, this? Yeah, he was shot by the officer's weapon. It's all the weapon's fault."
Last year, when measures, 55% of Republicans, that's more than half of Republicans measured, supported same-sex marriage.
@benshapiro
isn't only an idiot in regards to what this new law does, he's arguing a point of view a majority of Republicans don't agree with.
The problem that Jonah seems to ignore & that others have highlighted is that CRT bans are vague & CRT itself isn't being taught as a type of doctrine, so people in these schools start looking at slavery and racism as CRT & those topics will get impacted negatively.
This is the sort of cheap stolen base I see everywhere. The idea that if you’re not teaching CRT you’re not teaching about slavery or racism is b.s. bandwagoning.
@msolurin
I'm always amazed at how many people think "well, actually, police kill more whites every year" is some how a repudiation of the conversation around police reform.
Lori Laughlin was just sentenced to 2 months in jail.
Earlier this year, the Manhattan DA recommended one year jail for a man who stole cough syrup and toothpaste from a Duane Reade.
There are two systems of justice in this county and this is yet another example.
I hate that feeling when you make a really good dinner and you're all relaxed and content and then you realize you still have to clean the damn kitchen.
There are a lot of unnecessary regulations & a lot of regulations that, while maybe necessary, can often be enforced in a way that does more harm than good for businesses. But serving boiling hot coffee or finger food so hot it leaves blisters is a legit problem.
@KatyMontgomerie
Now, mind you, I was in an all men locker room, so maybe I'm missing something. But when changing in a locker room and feeling uncomfortable around others we just.... turned in toward the locker and changed real quick. It was uncomfortable in the moment, but no lasting trauma.
@ASFleischman
I got pulled over in Idaho for going 10 over the speed limit. I drove right by the cop & he was like "why didn't you slow down when you saw me?" He was not happy that my response was "I saw the huge "in god we trust" sticker & thought the U.S. didn't have religious policing units
That Shelby County DA is a piece of shit. It's no secret that people sucked into our justice system get punished for exercising their constitutional rights. But the DA's that are just so blatantly obnoxious about it are a special kind of shitty.
Shelby County DA defends six year prison sentence for woman who tried to register to vote while ineligible, saying the woman, Pamela Moses, is in part responsible because she refused to plead guilty.
Basically, my reaction to
@realDonaldTrump
's address was to respond to every other sentence with, "yeah, but
@AlexNowrasteh
, has already proven that false."
All lies, ladies and gentleman, all lies.
If you ever think someone knows what they are talking about *just because they went to law school* or *just because they teach* or *just because they have 25 years experience* Allow Joyce here to be a shining example of how false that is. she's done all 3 & this is wildly untrue.
Defendants who believe they’re innocent go to trial & clear their names. You have that same opportunity here. Innocent people don’t obstruct justice. They want the evidence to come out & witnesses to testify b/c they believe it’ll exonerate them. You seem to lack that confidence.
What the fuck is this false nonsense?
Look, heating up anything and inhaling it is going to be "not good for you." But Vapes ARE safer than cigarettes. Largely because they are cleaner. Cigarettes are full of tar & garbage.
❌Myth: Vape & heated tobacco products are safer alternatives to cigarettes.
✅Truth: These harmful products contain nicotine & toxic substances that can have harmful effects & long-term consequences on brain development, particularly for children & adolescents

Don't fuck up!! 😅
On a more serious note, back in law school one of my professors used to say "you're going to fuck up sometimes. Have the humility and courage to admit it when it happens and ask coworkers for help."
A few days ago I read a piece from

@Popehat
talking about hate speech, he ends with the story of Sidney Street. Classes start on Monday & when I cover the First Am. & my students ask about hate speech, I am going to tell that story. It's an important lesson to teach
Look, 10/7 was terrible. But Israel isn't some innocent bystander in this larger conflict & Gigi Hadid isn't actually wrong about Israeli soldiers doing heinous things like raping people. It's been well documented.
Absolutely despicable.
Gigi Hadid just posted the below to her millions of followers falsely accusing Israel of abducting, torturing, raping children.
Her example was Ahmed Almansara.
Here is video of Ahmed and his cousin running through a Jewish settlement looking for

My guy, many crimes put on the books after the ratification of the 13th Amendment were specifically written to criminalize the existence of free black people so the free prison labor could fill in for the lack of slavery.
Storming the Capitol Building in an attempt to stop the constitutionally mandated transfer of power while chanting things like "hang Mike Pence" does, in fact, make you a terrorist.
I bet they had plenty to say about protesters after the death of George Floyd. 🙄
The U.S. Government continues to exploit the events of January 6, 2021 to smear more Americans as “domestic terrorists.”
If we allow the state to criminalize peaceful dissent or protest, we lose what it means to be American.
The answers to her are overwhelmingly "white women dancing to black music and acting like black women"
But I've been assured America has never been a racist country. 🙄
Ok red-pillers, explain this to me. Is this bad because they’re dancing? Or dancing too sexually? Or holding alcohol? Or wearing jeans? Or not at home making sourdough? Or are assumptions being made about their faith or desire for a family? Genuine question. Please be specific.

@ShitpostRock
This game is so well done that I just can't help but love how much I hate the people in it. Jackie Wells and Panam are the real ones.
A new statistic to bring up in class. I often bring up voter disenfranchisement.
Voter disenfranchisement is a huge problem across the country & currently only two states do not have any criminal voter disenfranchisement laws.
@SII3IV2A
@WriterOfThings_
@BerniceKing
The other difference is that one was a black boy who couldn't get any support or financial help to get out of Rikers, while white Rittenhouse is now super popular, so even if his family couldn't afford bail, he'd have the financial support from others donating to the cause.
For those still confused. This is how systemic racism works. It doesn't require someone out there being maliciously, aggressively racist. The results happen because that's how those systems are designed.
The average LSAT score for black test takers is 142, while the average for white and Asian test takers is 153.
Nearly half of black law school applicants (49 percent) were not admitted to a single law school. That share is larger than that of any other racial or ethnic group.

"The more work I have to do, the harsher the punishment." & She did not take kindly to me responding with, "well if you're worried about the work. We can dismiss the case and you'll have no work."

Me: "Actually I do, but I'm serious."

Just anecdotally, I've noticed in my classes (especially since covid and the move to online teaching) that while more white male students talk during class. It was students of color, both men and women, who have more substantive answers to discussion post questions and whatnot.
You don't have a right to defend yourself from someone that is not an active threat to you. Protesters blocking traffic in San Francisco might be annoying, but they aren't actively a threat to you just because they caused traffic to backup.
@msolurin
Guy fetishizes an entire group of women based on race and then kills them when he can't act out such a fetish.... that is based on race. And they are going to say "it wasn't racially motivated."

My sister's kid started calling her by name & when she told him "my name is mommy, not Brittany" his response was, "okay... mommy Brittany" 😂
The responses in this thread are wild. If you're visiting a country that isn't yours, badic manners tell you to follow the customs of that country.
Tip the fuckin' waitstaff & then advocate for system changes. Not following tipping customs in a country you chose to visit? Rude.
Europeans visiting the US often don’t tip. They don’t understand that many professions here aren’t paid a living wage by their employers.
You don’t need to agree with this system. But you can’t take that frustration out on service staff.
Tip your waiters. Generously.

I remember being in Community College and hearing stories of Dershowitz and thinking, "that's the type of lawyer I want to be."
And..... oh boy.
Imagine being a "small government conservative" only to throw that philosophy away when it's DeSantis abusing government power to punish political speech.
@conservmillen
Can you imagine being a “tax the rich!” liberal only to throw away that philosophy when it’s DeSantis that removes the special tax privilege?
@BadLegalTakes
While this is a bad legal take... I wouldn't be surprised if Trump tried to pardon him, then threw a fit about presidential harassment when he found out he couldn't.
