@eliavl This “Trump Doctrine” is the most pernicious theory of global order since Schmitt’s Grossraum. Even Putin in Crimea paid lip service to the law, as did Israel, as Eliav explains. This doctrine undermines the UN's purposes and principles. A concerted rebuttal is imperative.

Such a helpful piece, a hard but practical read. Very strong coronavirus measures today should last a few weeks, there shouldn’t be a big peak after, and it can be done for a reasonable cost, saving millions. If we don’t take them, millions will die.

As I said in my lecture, without underestimating the tragedy, the loss and suffering of the Palestinians, the accusation of Genocide is just not the right framework because even if there is no genocidal intent, the duty to protect them remains valid under IHL and human rights law

It was sufficient to recognize that the Palestinians in Gaza could plausibly constitute a significant part of a national group, granting them the right to invoke the convention and attempt to prove the actus reus and mens rea of genocide.

The necessary conclusion from the Court’s Order must be that the Court has identified a corollary right to the right to be protected from genocide: the right to be protected against a reasonable sense of threat of being subjected to a genocidal attack.

In essence, the Court acknowledged that the Palestinians have a reason to fear that they are or might be subjected to genocide. The Court wanted to extend the protection of the Genocide Convention also against that sense of fear.
