Well hot damn, it’s about time. Worst kept secret in the city that it wasn’t enforceable. Next tackle the “outside of city limits” restriction on contributions.

The 5th Circuit finds an Austin city ordinance limiting political fundraising to a specific time period violates First Amendment rights in a challenge to the ordinance brought by Jennifer Virden. Ruling:

@JimmyJamesDTX @MQSullivan @Burrows4TX @JaredLPatterson FYI the Supreme Court has ruled this unconstitutional. You can’t block people on social media as an elected official if you use the account to talk about what you’re doing in office. It’s a 1A violation - right to petition govt

@Davy1836 @RebeccaMeals @Hollie_Plemons See my reply above. It’s 100% not subjective. It’s a legal term that has been affirmed by at least 100 yrs of judicial precedent around the country (and yes, including red states/GOP- appointed judges)

@RebeccaMeals @Hollie_Plemons He’s trying to stave off a constitutional challenge to the bill and the rule implementation. “Compelling state interest” and “least restrictive means” are straight down the middle con law 101 on first amdmt challenges. Likely re: freedom of association. It’s actually very smart

@RenzoDowney @TexasTribune @reptinderholt @toddahunter I don’t agree with Tinderholt often, but as Matt Schaefer said on X, moving the previous question is a declaration of war. Can’t remember the last time I’ve seen that used to stop rules amendments. Burrows (via Patterson) just slapped an iron fist on the table.

@RobertDownen_ @TexasTribune Won’t matter. They already know that the censures won’t keep anyone off the ballot. I’ve seen the legal memo they asked for. It’s not good. This is performative theater only

I did it again - another legal practice guide no one asked for! This time for San Antonio's ethics code. Did this one mostly for my own sake, but it's available on Amazon if anyone wants one.

Instead of resting up for the year ahead, I'm putting in hours. All you legislative & campaign lawyers asked and I listened - more CLE needed to get board certified. Modules for all parts of the exam, incl sample multiple choice and essay questions. Stay tuned for more soon!

I proactively reached out on this article to offer my solar panel story. Still not bullish on reform, but glad to see the industry stepping up to push out bad actors

Texas is behind in regulating residential solar companies. Guess who wants to change that?

@TweetTonyMac Yeah that’s probably right that it’s impossible to enforce, if only bc of lack of evidence. Unless someone starts recording conversations again

@satsuma_tx_all @James_Barragan This guy gets it. Mitch Little can give his trademark righteous indignation all he wants but it’s not over till it’s over. I usually tell people that the capitol is more like Veep than House of Cards, but the speaker’s race is ABSOLUTELY house of cards. Ambition > everything

@TweetTonyMac Big agree on that. Watson should have gotten this passed years ago before he left. The coupling basically ensures that it’ll never change

@TweetTonyMac Oh no worries Tony. I’ve been called worse this week already and I enjoy chatting with you on here - it’s much more academic and in depth than the usual “fuck you lib” I get.

@TweetTonyMac 3. I’m genuinely interested (not picking a fight) - you don’t think that EAO/rule proposal opens up more c4 political spending ? The rule moves the needle from 20% to 50% on pol. expenditures by c4’s before there’s a PAC presumption. That’s the opposite of what you’re saying
