#ConstitutionSaysNo: a tale in many parts. I'm collecting examples of Irish Govts saying they can't do something because it's unconstitutional and that a referendum would be needed, only to later conclude it's actually fine to just legislate. First up: specialist family courts.

I highly recommend this short, accessible article on the emergence of "constitutional identity" in the Irish system .Indeed, the concept reappeared in Hogan J's judgment in Tomás Heneghan v Govt of Ireland, delivered on Friday.
My first journal article is in this edition of @IJSJournal⬇️It looks at the use of 'constitutional identity' in Costello case, how it fits with the principle of popular sovereignty and the possibility of judicial empowerment.
