Here is where it worsens. A 24 year old man can now rape without fear of jail time.

It's not in guessing. A driver could go there to get the order, pick it up, then unassign it. New driver gets the order, arrives, food is gone, and now there's a problem.
Confirming the order limits food theft, because the last confirmed person with the order then is the driver.
