It's a very controversial topic, to say the least, and inspires strong opinions. I hope this will help shift the conversation in a productive direction:
In 2012, 36 states listed parental disability as grounds for termination of parental rights. I just finished a state-by-state analysis and found that 36 states still list parental disability as grounds for termination of parental rights! In other words, nothing has changed!
I'm tired of seeing the debates over if Britney is disabled. It doesn't matter if she identifies as disabled-the law has deemed that she is and she is being treated as such. Reproductive oppression of disabled people and those perceived as having disabilities is the issue.

Two reminders as a new semester begins:
Providing classroom accommodations for students with disabilities is not special treatment - it's fulfilling their legal right to an accessible education.
Laptop bans are ableist.
When he realized the train station elevator was broken, this dad did what he needed to do. He hoisted his son, who is paralyzed and uses a wheelchair, up a long flight of steps 💪
Reasonable accommodations for standardized tests are already near impossible to get when you need them, this will only make it worse for disabled students.

We are not in the business of deciding who “needs” them. We are in the business of teaching. This desire to be gatekeepers is why disabled people continue to be excluded from higher education. I teach and have never found myself unable to accommodate a request.
I really need law review editors and really all journal editors to understand, "disabled" is not a bad word! Identity-first language is entirely acceptable and preferred by many.

Imagine you’re a law student who realizes during week 2 of a 14-week semester that she needs to use a laptop in a class that bans laptops. Let’s say her hands hurt when she writes with a pen or pencil and taking notes on a laptop is significantly less painful.
So excited to see my article, "Achieving Justice for Disabled Parents and Their Children: An Abolitionist Approach," in print in the Yale Journal of Law & Feminism!

“On a personal level, I cannot emphasize just how disheartening it has been to realize how ableist our society is,” Powell, who is herself disabled, says. “I mean, I knew it, but the pandemic has brought it to new levels. We are seen as collateral damage.”
Nearly one in 10 children in the United States are at risk of being removed from their home by a child welfare agency simply because their parent has a disability.

While it is absolutely true that we provide inadequate mental health services in the US, the issue is guns. We need to stop stigmatizing people with mental health disabilities.
Once again, the anti-abortion movement is exploiting disability to argue their position. But make no mistake: abortion bans cause real harm to disabled people. We need to center the voices and experiences of the disability community in this debate.
I am really excited to share this new article: "Ableism in the Child Welfare System: Findings from a Qualitative Study," which is based on interviews with disabled parents, attorneys, and child welfare workers.
