Hey @amazonca, I bought a toaster, and got two toasters by mistake. But we were only charged for one. I’m trying to return it (without getting the refund, which would be fraud), but I literally cannot find any way to contact customer service to explain this. Help!

@Honickman And this is a practical constraint on judges making decisions that are *too* out of step with societal values. At a certain point, either the constitution or the judiciary loses its legitimacy.

Sanis Health v BC was on its face a narrow case about the constitutionality of a particular provision in a unique statute. But it also sets out a lot of broad propositions of class action law generally that will matter well beyond opioids litigation. Our comments below!
On the Docket, @PaulErikVeel, @bkolenda, and @JonathanChenTO discuss the #SCC’s latest decision in Sanis Health Inc v British Columbia, which has defined a broad scope for national class proceedings. –

@MichaelPlaxton I do think the current state of the Canadian legal academy is quite skewed to theory and other desk-bound work. There is a lot of low-hanging empirical fruit, and funding for those research projects would be a real value add.

@PulatYunusov Is there a new ex-McCarthys litigation boutique that I’ve missed? Or just a general observation?

Below are Jordana Sanft and my thoughts on the new administrative law cases out of the Supreme Court of Canada. Come for the terrible pun in the title, stay for everything you need to know about arguably the most important non-criminal cases the @SCC_eng will decide this year.
On the Docket, @SanftJordana and @PaulErikVeel discuss two recent #SCC decisions, Auer and TransAlta, which provide clarification on the standard of review applicable to challenges of subordinate legislation. –

@PulatYunusov 1) that’s a reason to criticize journalists and argue for more statistical literacy (which I support). That’s not a problem with the tools. 2) most people who are relying and acting on the polling data understand it better.

@PulatYunusov This isn't a failure of polling or statistical methods. It's a failure to understand what polls and forecasts really show.
