I haven’t followed the case but—The Executive Branch is bound (in theory) by what the Judiciary rules in a case in which the Executive is a party. SCOTUS is the top of the Judicial Branch, but SCOTUS’s original jurisdiction is very narrow. The way issues reach SCOTUS for decision is typically via appellate jurisdiction, that is, an appeal from the lower federal courts. States would generally have standing to sue if they suffer a concrete injury as a result of federal action. I imagine that’s the claim here—but like I say I haven’t followed the case.

This is why one shouldn’t read anything written during one’s own lifetime. One never knows a work is good until it’s survived a few generations. Setting aside law review articles, obviously.
