I'd like all young Taiwanese to watch this. That's where, among others, Taiwan democracy began. Under the authoritarian regime, ballot rigging had been a common practice. Ppl, with a limited right to vote in some local elections, started to question the ballot counting. (1/3)

這篇用漢字，因為想把這份心情傳遞給心愛的台灣。引文裡說的，也是我對烏克蘭法律動員策略的心得：國際法分崩離析的當下，正是國際法反撲的時刻。即使上國際法院得不到想要的答案，即使國際刑事法院也拿不下罪犯，即使歐洲人權法院的暫定措施無效，也不能放棄製造議論的空間，讓問題浮出檯面。
Law must fight back even in face of no prospects for victory. Options must be explored to show that attempts were made, and once the smoke clears hopefully there will be momentum to revamp the post-WW2 setup of international law that is falling apart before our eyes. (10/12)

許多國際法學者這幾天都轉貼了Alain Pellet教授的公開辭職信。Pellet打了數十次國際法院訴訟。戰事爆發後，他發表公開信辭去了三宗烏俄繫屬中案件的律師或顧問職。其中沈痛地表示：「律師可以為或多或少有待商榷的爭點辯護，但無法在一個注定要適用法律的處境中，出面為犬儒鄙視法律的國家辯護。」

台灣對人權保障經常治標不治本的問題，其實應該只是大結構的冰山一角。一個預算很緊的委託研究，往往要求八個月就提供藥方，沒有時間和資源去充分盤點利害關係人處境，所謂跨域整合也只能停留在共同主持和專家焦點會談。如果真的預算有限，那就分年一階一階去推進，五年十年的計畫有其必要。

這裡的權力分立原則很簡單，增修條文體制下，總統由人民直選，對人民負責；對立法院負責的是行政院，所以政院接受立委質詢剛好而已。即使是權力制衡體制，對立院負責的仍然不是總統。總統有國安大政方針權，於其職權範圍內為最高行政首長（釋字627參照），但終究不是對立院負責的政院。(2/6)

教書這些年，的確開始有種使命感，意識到自己一定程度扮演著公共利益的代言角色，即使學術上更常站在社會宣稱的公共利益對立面。
1/ 每年總要找機會，告訴公立大學的學生，他們享有的學術資源是龐大的公共投資，而學費只占其中兩三成。國家賭上一把，好讓這些篩選過的青年未來能一起支撐這個國家。

台灣的好學校都是公立的，因為政府與納稅人希望投資這些會考試的菁英以後為台灣思考、奮鬥、不要落下任何同胞，讓台灣壯大。而不是考完拿到這些資源覺得應得的，然後用來打壓當初付出投資的人們。

最後妥協版本，總統報告完離席後，國會再進行辯論。曾有法國學者私下戲稱，這是總統彰顯權力的玩具。讓總統威風一下，開心就好，但不超越權力分立的紅線。總統終究只對人民負政治責任。而政治責任的追究，台灣至少還有個形式上的正副總統罷免，即使門檻高不可攀，而法國第五共和並沒有罷免制度。(4/6)

波蘭學者建議台灣，俄羅斯退出歐洲理事會（歐洲人權法院所在組織）之後留下的預算缺口，除了歐洲國家填補，海外人權盟友也能參與，例如台灣這樣民主法治持續前進的範例。
對照：美洲人權法院也有歐盟或歐洲各國捐款支持，彰顯外交政策內含的價值。

補一句。高中生能跳出本位，認真描述、檢視自己先前做的小小試驗，還能補充後來學到的方法可能如何改善當時的結果。像我這種當年只會應付考試的大學老師，聽著聽著真的會放棄計較，面前這位同學可能語文弱了點或是數學差了些。那背後的無限可能的成長空間，應該是值得大學珍視的。

A visiting scholar from Ottawa told me that it’s a beautiful campus embraced by rivers, mountains, biking trails and a baseball park.
