I practice enough freedom of expression law (as we call it in Canada) and aviation law to know that if any rando were to go up and commandeer an aircraft's PA (which is a critical safety system), they'd need a criminal lawyer.

I only do criminal law, so I am not a "free speech" expert. But my quick look at a s. 2b (freedom expression) seems to indicate that "free speech" does not grant the right to make airplane PA announcements? This is dumb.

Retail stores are private property. Owners can put conditions on entry, if not discriminatory. It's remarkable that the people who seem to freak out the most about having to wear masks are people who otherwise defend the right to refuse services on a discriminatory basis. #Tison

If a child were to confide in a teacher that their parents will beat them if they don't pass their English test, will you then respect the role that parents play within that school system? Would you use the notwithstanding clause to quash the child's right to safety?

Parents want the role they play in their child’s life respected within the school system. I agree. And we can do that while still providing a safe and welcoming environment for all students.

yes, bc once again, bill c63 doesn’t exist in isolation from section 718.1 or common law principles on sentencing that binds judges — I never claimed that this was written into the text of c63 as you (and others) seem to be repeatedly implying

It is problematic when politicians appear to not fully understand their own bills, and when people who know more about the space than they do point it out, they call it misinformation and disinformation. And there's something deeply anti-democratic about that.

When government MPs such as @TimLouisKitCon call the majority of expert testimony and analysis on user content regulation in Bill C-11 – corroborated by the CRTC Chair – misinformation, it creates risks to freedom of expression that cannot be ignored.

This is a little cool. I just found out that this is the twelfth year that I'm listed in Best Lawyers in Canada, now also under their new-ish category of privacy lawyers. I'm also named as "Lawyer of the Year" for Halifax in the category of IT law.

The Online Harms Act is a testament to the hard work of advocates like Carol Todd @AToddLegacy . Carol suffered an unimaginable tragedy when her daughter Amanda took her own life after being sextorted online. Carol, thank you. We are working to pass C-63 for you, and for Amanda.

I wonder if first generation Canadians and Canadian cultural communities are aware that Bill C-10 will affect their access to content from other countries? It's not just about "web giants". It's also about connections to countries of origin.

Heritage Minister @s_guilbeault claims Bill C-10 will generate $830M annually as he “gets money from web giants”. The reality? Canadian consumers likely to face new Cancon regulatory charges that could lead to big increase in the cost of digital services

This is shameful. We've already seen @s_guilbeault smearing expert academics and commentators as part of a conservative fringe camp. Now he's positioning this as an English Canada v. French Canada wedge. Time to go, Minister.

The government really needs to hit the reset button on all of its digital policy, take this out of the hands of @s_guilbeault (and whoever is advising him) and give it a full re-think. The worst is yet to come.

It's amazing to me how many people imagine that the Online News Act makes sense. The whole thing is facially premised on the notion that "big tech" extracts more value from news media than the other way around. And supporters get outraged when shown that's not at all the case.

It’s disappointing to hear that Google is trying to block access to news sites. Canadians won’t be intimidated. At the end of the day, all we’re asking the tech giants to do is compensate journalists when they use their work. (1/2)

This may be relevant to some folks today: There is no single privacy law in Canada, statutory or common law, that grants privacy rights to organizations.

This will go down in history as a phenomenal public policy mistake and miscalculation. And the fact that the Minister has crazy-glued (pun intended) 😉his personal brand to it means it'll be the first paragraph in his political obituary.

I am thinking that a good reopening plan would provide the relevant public health guidance on how to reopen with enough advance notice to actually implement it. And childcare should open first so that all employees actually have the ability to return to work.

@JesseBrown Careful with wording. Infringement of a Charter right is very different from the suspension of a Charter right. Rights were indeed infringed, but likely justifiably. But invoking the Act would have been unnecessary if the police of jurisdiction had done their jobs.

There is no "suspending" this law. It was passed, received royal assent. It comes fully into force no later than Dec. 19. The govt put this train on the tracks, hit the accelerator and removed the brakes. We are watching a disaster of public policy unfold before our eyes.

The opportunism is just relentless. Suspend the Online News Act for the duration, if you’re so concerned about people getting news they can already get just by going to any news organization’s website: the kind Facebook used to point people to until they had to pay a fine for it.
