It has been standard procedure in Suffolk DAs since a minimum of 2010 on serious cases - s/a, homicides, armed robberies etc.
I believe it is done less than Norfolk County, but it’s very standard in many places.

The way I read it is - The language throughout the rule as well as the reporters notes is ‘may’ - thereby giving permission to do it but not requiring it. The only ‘must’ I see is relative to the need to record the verdict on charges of which they are unanimous before a mistrial
