Just as there is a uni-party there is also a uni-judiciary. The people were always meant to have the final say about what the Constitution means. The people form the Union. The people are sovereign. There is nothing in the Constitution that makes the courts the superior branch. In fact, they’re systemically the weakest one because the judiciary is the only branch entirely reliant upon the other two. It can’t appoint, confirm, or fund itself. Nor can it enforce its own edicts (it has no standing army or police force). Madison makes this clear in the Federalist Papers. Jefferson spent much of his political life warning against exactly where we are now with the judiciary. The canard of “judicial supremacy” came from the earliest progressives, who replaced natural law (man’s law based on eternal attributes/standards revealed in the natural world) with legal positivism (or whatever human authority now says is law is binding as such regardless of what was previously revealed or recognized in the natural world). And they did so knowing full well this was the only way to move us as far Left as they wanted to go — giving unlimited power to unelected officials — because as standalone ideas the people would never vote for them soup to nuts. Just as there is a uni-party, there is also uni-judiciary. For decades, the controlled opposition Right played along with this Constitutional heresy of an all-powerful judiciary — albeit for different reasons. Letting judges on both sides fight the culture war absolved them of their already abrogated duty. In other words, Republicans could just lie to us by running on what we believe to get elected and entrenched, but then like the Pontius Pilates they truly were, washing their hands of the matter once “the courts have spoken.” Almost everything we voted for will be washed away by those we did not, unless the Trump Administration applies the same level of heroic disruption to the courts as it is virtually everything else as we speak. The Trump Administration should move forward with enforcing its actions that are clearly Constitutional, regardless of what communists in black robes who have no enforcement power think. Use the precedent of Biden defying the courts to unconstitutionally forgive student loan debt as its PR shield. Otherwise, the courts may end up doing to this Trump presidency what the scamdemic did to the last one. Then, let the people have the final say in the next election on which interpretation of the Constitution they want — Trump’s or the courts’ — just as it was always intended.
