The abatement point in SC verdict was clearly illegal. Abatement under crpc is limited to trial and HC. In this case she died not only before SC verdict but also after completion of hearing and judgment ws reserved. SC Bench violated its own rules when it said charges abated.

To further clarify, magistrates don't approve filing of FIR. What the law & SC say is there can be no FIR for defamation. It can be prosecuted only through private complaint (this means a private crl case filed by aggrieved person) before magistrate. Police have no role in this.
UP police registered an FIR against me after Deep Srivastava filed a complaint of defamation.
As per law, an FIR for criminal defamation can only be filed after a magistrate's approval.
UP police bypassed this & registered an FIR under IPC 500 and 501.

Unqualified endorsement isn't very becoming of a constitutional court. It's especially wrong to have rejected the proportionality arguments. Anyway, it was taken up too late to make a difference. Wish the dissent had not joined in endorsing the noteban's claimed objectives.
