Judicial independence at risk from case withdrawals, says Justice Mansoor Ali Shah The registrar explained that the Practice and Procedure Committee had referred the case to a constitutional bench, which reviewed relevant amendments and scheduled cases accordingly. However, Justice Shah emphasised that once a case is with a judicial bench, the committee's involvement ends. Allowing committees to withdraw active cases undermines judicial independence. He questioned whether cases could be withdrawn simply because decisions might not favour the government. This case should go to a full bench to resolve the issue.

ممبر ہونے کے باوجود کمیٹی کے اجلاس سے لاعلم، جسٹس شاہ سپریم کورٹ کے ججوں نے کیس شیڈولنگ میں شفافیت کے فقدان پر تشویش کا اظہار کیا ہے، جسٹس منصور علی شاہ کا کہنا ہے کہ وہ رکن ہونے کے باوجود ججز کمیٹی کے اجلاس سے لاعلم تھے۔ 20 جنوری دوپہر 1:00 بجے۔ سپریم کورٹ نے کہا کہ اس نے کیس کو اسی بنچ کے سامنے طے کرنے کا حکم دیا ہے۔ عدالت نے نوٹ کیا کہ اس دن کیس کی کاز لسٹ جاری نہیں کی گئی تھی اور ایڈیشنل رجسٹرار صحت کے مسائل کی وجہ سے غیر حاضر تھے۔ سپریم کورٹ کے دفتر کی جانب سے مزید بتایا گیا کہ ججز کمیٹی نے 27 جنوری کو آئینی بنچ کے سامنے کیس کی سماعت مقرر کی تھی۔ تاہم، دفتر کو ابھی تک ججز کمیٹی کے میٹنگ منٹس موصول نہیں ہوئے جہاں یہ فیصلہ کیا گیا۔ عدالت عظمیٰ نے سوال کیا کہ 16 جنوری کے عدالتی حکم کو کیسے نظر انداز کیا جا سکتا ہے۔ یہ بھی بتایا گیا کہ اس بنچ کے سامنے ٹیکس سے متعلق تمام کیسز منسوخ کر دیے گئے ہیں۔ مزید برآں، عدالت کو بتایا گیا کہ اب ایک ریسرچ آفیسر اس بات کا تعین کرے گا کہ کون سے کیسز کو آئینی بنچ کے سامنے جانا چاہیے، ججز کی کمیٹی کے جاری کردہ عدالتی حکم کو مؤثر طریقے سے نظرانداز کرتے ہوئے جسٹس عائشہ ملک نے ریمارکس دیئے کہ کیا اب کوئی تحقیقاتی افسر فیصلہ کرے گا کہ کیس کہاں طے کیا جائے؟ جسٹس منصور علی شاہ نے کہا کہ کیس انتظامی کمیٹی کو منتقل کر دیا گیا ہے۔ انہوں نے سوال کیا کہ اگر جسٹس عرفان سعادت دستیاب نہیں ہیں تو بینچ کے لیے کسی اور جج کو کیوں نہیں سونپا جا سکتا، اس بات پر زور دیتے ہوئے کہ کمیٹی کے پاس کیس کو شیڈول ہونے سے روکنے کا کوئی اختیار نہیں ہے۔ جسٹس عائشہ ملک نے مزید کہا کہ کمیٹی کے پاس کیس مکمل طور پر منتقل کرنے کا اختیار نہیں ہے۔ انہوں نے مزید کہا کہ 26ویں آئینی ترمیم کے تحت اس بنچ کو آئینی بنچ کے طور پر بھیجا جانا چاہئے اور اس معاملے پر ان کی عدالت میں بحث ہو سکتی تھی۔

Judge Nasir Javed Rana History Pak court acquits two sons of ex-PM Nawaz Sharif in corruption cases Hassan and Hussain Nawaz were implicated in the Avenfield, Flagship, and Al-Azizia corruption cases in 2018 related to the Panama Papers. A Pakistan anti-corruption court on Tuesday acquitted the two sons of PML-N supremo Nawaz Sharif in three cases of alleged corruption, nearly ending the legal woes faced by the former prime minister's family. Hassan and Hussain Nawaz were implicated in the Avenfield, Flagship, and Al-Azizia corruption cases in 2018 related to the Panama Papers. In 2018, the two brothers were declared proclaimed offenders after they failed to join the investigation in Avenfield Apartment, Al-Azizia and Flagship Investment cases filed by the National Accountability Bureau (NAB). However, their trials were not held as they were abroad while their father Sharif, the main accused, was convicted in the Avenfiled and Al-Azizia corruption cases but acquitted in the Flagship case. The three-time former prime minister and Pakistan Muslim League-Nawaz (PML-N) chief Sharif returned from London to Pakistan in October last year after ending his self-exile for nearly four years. He challenged his conviction in the two cases and the Islamabad High Court acquitted him. This emboldened his sons to return from London to face the charges. They returned on March 12 after the court had suspended their absconder status until March 14 when they finally appeared before the court and were given bail. They had also asked the court to acquit them after the main accused was exonerated. On Tuesday, the acquittal plea was heard by the accountability court. Judge Nasir Javed Rana after hearing the case, acquitted the two in all three cases. Earlier the same court granted Sharif's sons major relief by revoking its earlier order declaring them proclaimed offenders and cancelling their permanent arrest warrants. With the cases against his two sons wrapped up with Tuesday's acquittal, the entire family of Nawaz Sharif has been exonerated in cases which were launched against him and his family members in 2017 when he was disqualified by the Supreme Court.
