hehehe they actually are all proper topology! All the eyelashes and mouth parts are separate little flat meshes, this way there can be smooth blinking and other animations!
The other method you're thinking about is likely swapping out different face textures maybe?

not sure if its the norm but i think it's fine to make 3d fanart without strictly needing to ask everytime... though it wouldn't hurt to ask. It's a nice gesture.
If distribution or money is involved then yeah permission and clear communications is very important
