In a surprising turn of events… South Korea’s largest law firm, Kim & Chang (HYBE’s law firm), was found to have violated labor laws after an inspection by the Seoul Employment and Labor Office. The firm failed to properly document employment contracts and work regulations, basic legal requirements for all businesses. The investigation was triggered by a complaint from a former associate lawyer who reported excessive workloads without proper legal protections. Kim & Chang ignored the legally mandated 52-hour workweek for lawyers, while other major firms adopted a discretionary work system to comply. Associates at Kim & Chang frequently work 60–70 hours per week, often leaving the office past midnight. The intense workload has led to health issues, stress, and even resignations. Unlike other industries where labor unions negotiate working conditions, associates at major law firms lack any collective representation. Historically, lawyers at Kim & Chang either remained silent, left the firm, or worked toward becoming partners, avoiding direct confrontation over labor conditions. Recently, associates in other large firms have begun rejecting discretionary work agreements, demanding better compensation for excessive hours. This shift is driven by increased competition in the legal industry, stagnant wages, and improved working conditions in other high-paying jobs, such as at large corporations. Kim & Chang held a vote on introducing a discretionary work system, but the process was criticized as unfair and coercive. Associates were required to vote in front of senior lawyers, making dissent difficult. The process was likened to a “Squid Game” scenario, where employees had no real choice but to comply. The firm argued that legal work is difficult to regulate under standard labor laws, as lawyers work flexibly based on client needs. They also claimed they were attempting to distribute workloads more evenly rather than adopting a discretionary work system. The case raises questions about whether high-income professionals should be exempt from labor regulations. Comparisons were made to systems in the U.S. and Japan, but critics argue that Korea’s labor environment and worker protections differ significantly. Kim & Chang’s labor violations expose long-standing issues in Korea’s legal industry, particularly regarding overwork and lack of worker representation.
