I would never say “it couldn’t happen here” about the racial violence in England.
But I’m VERY confident it won’t. We just don’t have quite that critical mass of human scum.

I am not sure these two statements are at odds. One recognizes that breach of treaty rights is a constitutional claim made under section 35 of Constitution Act, 1982, while the other states that prior to enactment of section 35 in 1982, remedies for breaches existed at common law
Perhaps obscured by the tortuous reasons here is a question of legal taxonomy. Jamal J. states: "treaty claims are not actions in the nature of tort or contract" and are "constitutional" [210].
But in Jim Shot Both Sides, earlier this year, O'Bonsawin J. suggests the opposite...
