To say Pokémon cards do not provide access to an ecosystem is to say you never played Pokémon. This argument to avoid sweeping them in as securities but still tag tokens is, well, absurd. Do I need to retain this author as an expert witness under Fed. R. Evid. 701?

Crypto is lucky to have @jerrybrito & @coincenter . But they (and many of us) put out 5-alarm fires bc the crypto industry underinvests in educating legislators upfront. Where are the loud anti @fund_defi conspiracy theorists now? Silent & useless. Fortunately more help is coming

Continue to hear commentators saying Judge Torres held that XRP is a security when sold to institutions and not a security when sold to retail. This is incorrect. Judge Torres held that XRP itself is not a security, but it can be sold as part of a security. /1
