Did some research. Avg wait once an individual starts using app to get appt is ~70 days. People are trying basically every day—that’s whole point of dangerous, expensive journey! So that means it’s ~1M people who have tried, and ~400k have entered so far. The 64M is irrelevant.

New DACA rule is out. Many are reading now. I want to give caution to DACA recipients that 1) this cant take effect for 60 days 2) would only if no new/existing litigation interferes (high probability of this) 3) deep caution that this will to alter trajectory/threat in courts

This morning the Biden administration is in court arguing to keep Title 42 in place. Title 42 was wrong in 2020 Title 42 was wrong in 2021 Title 42 is still wrong in 2022 No one* actually thinks it is a public health effort. The administration should end Title 42 right now.

Last Friday, a Federal Judge ordered the Biden admin must apply Title 42 to unaccompanied kids. The admin has not yet appealed this ruling. The order takes at midnight *tonight* unless the Biden admin gets a stay (hold) on the ruling. Thats less than 16 hours from now.

The Parliamentarian has advised this 2nd Title 42 Amdt currently under debate does not pass the Byrd rule. It is bad policy, and also anyone who had called for such guidance to hold previously should vote no on this amendment.

If DACA ends, then without legislation, here’s what happens: each & every day, Monday through Friday, a new group of 1000 DACA recipients loses their job, for two years. Again: thats 1000 new people a day, every day, for 730 days until its the full ~620k purged from their jobs.

This is a must read from @mjs_DC on the policy of the DC criminal code rewrite — which was, again, the result of a 16 year process and a common sense set of reforms similar to those done in 37 other states — and states that have seen crime go down after.

Dems really have to find a way to communicate that one key to a stable, orderly system is *more* legal immigration, not less, that a well managed asylum system is *possible.* Stop validating the GOP frame that the only answer to disorder is restrictions.

JUST IN — In a surprising ruling, Judge Drew Tipton dismisses a Texas lawsuit against a Biden administration policy that allows up to 30,000 migrants from 4 countries to fly to the US each month if they have US sponsors. Tipton said Texas failed to show it “suffered an injury.”

Applying Title 42 to unaccompanied kids is (and sorry, twitter has character limits) an anti-septic euphemism. It means a 9 year old—or all kids under 18–who tries to seek asylum will be denied even a hearing and be immediately deported. The appeal should have been filed Monday.

We reject the false concept that creating and maintaining working, legal pathways that allow people to come to the U.S. safely need to be held in some sort of feigned balance against eliminating the fundamental right to seek asylum.” That’s just a very topline though.

Title 42 was an inhumane and horrid policy in 2020. It is today. It has been since then an effort to eliminate the ability to people to apply for refuge in the US—it was not and has never been about public health. End Title 42 now.

Reading now but TOPLINES: 1) As expected, Judge Hanen (very wrongly) again ruled DACA is illegal 2) Renewals for existing DACA recipients can continue (he could not touch the stay)—so status quo holds 3) Now goes back up to 5th Circuit to rule on merits & stay & eventually SCOTUS

BREAKING — Judge Andrew Hanen again declares the DACA program for "Dreamers" illegal, striking down a Biden effort to codify the policy into a federal regulation. Hanen is keeping DACA intact for current recipients, allowing the government to process renewal requests. @CBSNews .

Update just now on schedule of 5th circuit DACA case (not anything unexpected) - 5th circuit responds to DOJ request & says they can submit supplemental briefs, but must do so by next Thursday. Very fast turnaround. Decision could come as soon as Sept. 1/2

Ever since Trump and Judge Hanen halted DACA, hundreds of thousands of undocumented Dreamers who have been graduating high school and going to college have been locked out of the program. We are hurting ourselves as a nation by not providing them a way to fix their status.

We can be exhausted, can point out its not 2 years ago & we can make hard decisions (like the incredible value of schools) but that requires investment designed to protect one another. To this very impt point…the current administration has had Title 42 in place longer than last one—and it is the official, communicated stance (on the record) that this is CDC’s call. Just bc people don’t believe that to be true doesnt mean it should not be a daily question.

Seconding folks who would like to see a question about Title 42 at this briefing. It’s been in place for nearly 2 years. DHS says it’s 100% CDC’s call. CDC has literally never mentioned or defended it to press.
