There are lots of Elizabeths-many are devoted moms.
Pick your closest analogy--a random Liz with two kids, convicted of fraud around drug charges...and ask yourself why the details of her life and what long incarceration means are any less meaningful?
This is of course entirely in clear violation of the 14th amendment.
No one should act like this is a valid debate. Instead, just dismiss anyone who pretends otherwise—and not just in this issue.
Pls dont read this as a call for more punitive coverage, let alone sentences. It's not. It's that all the Elizabeth's deserve the chance for the world to understand (and society to change)what many years in prison will mean for their families as much as the super rich white ones.

Can’t believe that silly state based reporter was so biased and didn’t have the clear-eyes objectivity of an unregistered oil and gas LobbyisTraregic consultant I mean
Today a former Trump admin official referred to legally migrating as a plot by the Biden admin for “artificially decreasing” unauthorized migration.
Who could have guessed the people who tried to slash legal immigration avenues aren’t really concerned about “legality”
Been a long while since I’ve seen such a (entirely deserved) response to someone coming to a DC event. So incredible to have
@giselefetterman
here tonight with hundreds of Dreamers and others.
It is an honor to host
@giselefetterman

recipients to a roaring applause. Thank you for your support as we call on Congress to deliver permanent protections for Dreamers before the end of this year.

NEW - Our analysis and statement on today’s awful 5th Circuit decision that DACA is illegal.
There is a *lot* of confusion but this is a big step forward to the courts terminating DACA. Congress absolutely has to act this year —>
NEW
@FWDus
Statement on 5th Circuit DACA Ruling: Congress Must Respond to This Devastating Ruling & Pass Legislation Protecting DACA Recipients Immediately
NEW TODAY—with full page ad in
@WSJ
& in wake of 5th Circuit ruling DACA unlawful, over 80 of the largest companies, trade assns & business leaders call on Congress to act to pass bipartisan permanent protections for DACA in lame duck.
Story from NBC -
Lots of critical steps needed here and this language wouldn’t have been nearly enough. But we are so long past time to eliminate discriminatory country caps, stop wasting visas, protect DVs and more. We need urgent legislative and administrative action.
The Washington Post Editorial Board — 16 days apart.
When it’s 4 million people fleeing the Ukraine in 4 weeks, it is “Open U.S to Ukrainian refugees—now” but a ***drastically lower number of people over years*** at the US-Mexico seeking refuge from many countries is a “tsunami”
NEW & TODAY!
Hundreds of DACA recipients and those demanding for Congress pass permanent protections for Dreamers in lame duck are arriving in DC and heading to Capitol Hill.
Great to have so many folks in town!
Did some research. Avg wait once an individual starts using app to get appt is ~70 days. People are trying basically every day—that’s whole point of dangerous, expensive journey! So that means it’s ~1M people who have tried, and ~400k have entered so far. The 64M is irrelevant.
NEWS — Migrants in Mexico have made over 64.3 million requests to enter the U.S. using a smartphone app that the Biden administration has tried to establish as the main gateway to the American asylum system, internal documents obtained by CBS News show.
I mean…the last few weeks have proven exactly why the legislative filibuster is particularly terrible for both progressive causes AND the Democratic party’s political outlook. National Review accidentally making the correct case against carve-out plan (vs full end) is funny tho
"Look, relax everyone! If we remove the filibuster for abortion and voting rights legislation, there's no way this move can backfire on us if and when the GOP wins back a Senate majority!"
Anyway -- two resources:
1) Here's a report on how media coverage in New York has intersected with the politics, and demagougery, around pretrial incarceration and sentencing.
2) If you want to learn more about how criminal justice systems harm mothers over and over again each day, you can read this report on Oklahoma's "Failure to Protect" laws
New DACA rule is out. Many are reading now.
I want to give caution to DACA recipients that
1) this cant take effect for 60 days
2) would only if no new/existing litigation interferes (high probability of this)
3) deep caution that this will to alter trajectory/threat in courts
Well Ari - there was *a lot* more unauthorized migration in 2001-2003 than 2021-2023. You were the Press Secretary those years; was that the term you used from the podium?
The consequences for DACA ending without legislation are devastating. This lame duck is the chance. We are encouraged by the reported bipartisan progress between Senators Sinema and Tillis around a comprimise for Dreamer legislation.
Here is our statement from

This morning the Biden administration is in court arguing to keep Title 42 in place.
Title 42 was wrong in 2020
Title 42 was wrong in 2021
Title 42 is still wrong in 2022
No one* actually thinks it is a public health effort.
The administration should end Title 42 right now.
Huisha-Huisha Title 42 oral arg. here:
Wednesday, January 19, 2022 9:30 A.M. USCA (Live-Stream) Judges Srinivasan, Wilkins, Walker
Case#: 21-5200 Nancy Huisha-Huisha v. Alejandro Mayorkas (15 minutes per side) [this case is 3rd up, so about 10:15am?]
Last Friday, a Federal Judge ordered the Biden admin must apply Title 42 to unaccompanied kids.
The admin has not yet appealed this ruling.
The order takes at midnight *tonight* unless the Biden admin gets a stay (hold) on the ruling.
Thats less than 16 hours from now.
I will also add -- if you're interested in how the use of langauge and the choices media make show in a very deep ways on policies and opinions that impact millions, please check out this report on People First language.
The Parliamentarian has advised this 2nd Title 42 Amdt currently under debate does not pass the Byrd rule. It is bad policy, and also anyone who had called for such guidance to hold previously should vote no on this amendment.
@nycsouthpaw
Thankfully there are no other forms of communication past email that twitter might have access and its a super cool move to not redact a member of congress’s email.
Ah yes - the Senate Parliamentarian giving guidance that drug prices can be negotiated via a 50 vote margin in Medicare but not in private insurance plans some with heavy public subsidies (that takes 60 of course!)…just like the founders explicitly wrote when in the Constitution
A vile comment equating people seeking asylum or coming to US to work with Putin’s military invasion (in which he gestures to nuclear weapons). No surprise it’s a man whose campaign imploded in part bc he got caught lying desperately & constantly about his own immigration policy.
It’s terrible the Taliban run Afghanistan; also, thats been where this was heading for a long time. Its also really terrible that millions of Afghans face mass malnutrition & starvation.
Right now the US is only impacting the later & this could make an existing horror worse.
Congress is about to pass a law that would bar the Pentagon from spending any money at all assisting Afghanistan in any way, including transporting their own currency to them, or flying in aid after an earthquake.
Truly evil.
5 million people have qualified to immigrate and are just waiting for a visa number to be available. They and their families have waited *decades* in some cases and shouldn't have to wait longer because of bureaucratic mistakes and failed, outdated policy.
NEWS:
Immigrants hoping for backlog relief are poised to lose out in approps package. Top Senate homeland appropriator says green card recapture provisions proposed in earlier bills likely to be left out of deal

I believe the days ahead will be filled with the stories of people who built their lives here for decades. Who have fallen in love & married with US citizens, and who have made America better as a result.
And I believe this guy is scared as he knows voters want families
@mattyglesias
DC is the most heavily policed major city on the US. We incarcerate at a higher rate than any state, and any other country, and possibly* any jurisdiction in the world. We have very long sentences & very high racial disparities.
This status who fails on many levels—but …1/2
The US is on pace to settle less than 12,000 refugees* this year—which is 91% below their target and about what President Trump did during 2020. They can and must take immediate action to fix this.
Three months in, the U.S. has admitted 3,268 refugees in fiscal year 2022, which started in October, newly published government figures show.
The Biden administration set an ambitious goal of resettling up to 125,000 refugees this fiscal year. Data:
It is important to be clear:
Governor Hochul’s proposed 10-point plan is the most massive rollback on criminal justice reform in any state—by a Republican or Democrat—in the last two decades—and would be the biggest proposed increase in incarceration in the last two decades.
Just to follow up on this—in the ruling from Judge Tipton last night in the CHNV cases, he wrote that **Texas (aka Ken Paxton)** agreed these programs reduces pressured at the border. So—for once!—take Ken Paxton’s word for it.
The latest lie on the right is that Biden is "secretly" flying in tens of thousands of migrants. Musk & Trump are all over this.
It's pure BS, as
@JuddLegum
and others have shown. But it's worse than this. The programs *reduce* pressure on the border! 4/
They flew 48 people who hoped America might offer refuge to Martha's Vineyard bc they see it as good politics to distract from their work to criminalize all abortions, force child victims of rape to give birth, & to gut social security & medicare to fund tax cuts for billionaires
Absolutely horrible, devastating news. For whatever individual reasons the dozens who lost their lives came to the US in search of a better life, they certainly wouldn’t have ever hoped to have come in these horrific, deadly conditions into which our country pushes people….
The death toll in San Antonio has risen to 46 people, authorities said, in what appeared to be one of the worst episodes of migrant death in recent years. Three people are in custody, the police chief said.
Follow live updates:
This appears orchestrated for maximum cruelty and confusion:
*No heads up in advance, official says
*Unclear whether Charlie Baker, the GOP gov of Mass, was given heads up
*Planes apparently went from Tex and made stops in FL and NC, I'm told
Worth noting that yesterday, the current DOJ started to appeal a decision that would have given visas to approximately 10,000 people denied them by the subsequent versions of these bans. Again, DOJ did this yesterday.

I think some of the patrons are parents who have kids at the mathnasium a block over. Do some shopping, have a beer…a solid hour.
But only some so I agree it’s odd!
I drove by at 8:30 doing drop off. Stopped by & tried to follow rule of find helpers closest to the work & try to help in way they say they need.
They asked those who can give to help people here: .
Asked for help explain whats happening, so let me try…
Anyway, been a day but the Martha’s Vineyard stunt backfired in a massive way.
Amazing the political geniuses who brought you family separation and swore it would be massively popular once again don’t get it.
Title 42 was wrong in 2020.
Title 42 was wrong in 2021.
Title 42 is wrong in 2022.
End it now. It’s wrong, it’s chaotic, it’s absolutely not about public health (no one even pretends it is) so do the right thing and end it right now.
Impt piece from
@GregTSargent
on why attacks on orderly, lawful migration pathways are the core dispute — and why some are desperate to a tank a deal that would protect parole pathways (bc they either don’t like immigrants period and/or want more chaos)
On this: no one pushes myth of "the border is open and you get a work permit upon arrival" more than the anti-immigrant movement & media allies. The cartels then quote them. But the twitter pundits going with "trump bad, but..." & repeating & above are pushing it hard this week.
On the topic of smugglers who lie to people about US policies, in 2018

talked to a man who'd been told on his way to the US that year that Obama was president and was handing out work permits. Seriously.
The whole thread is worth your read.

NEW -
@FWDus
TV Ad campaign begins on the need to Protect American Families. Rosa and Everk’s family—and all Americans—can be together and thrive if there is parole-in-place for the spouses of US Citizens.
Let’s go make this happen!
A few points!
1) 1.5 million Americans signed up in a month to sponsor folks!
2) Of course there‘s pent up demand after years of blocking nearly all immigration!
3) This story shows this is working and we need to keep and improve legal migration pathways!
What this means:
1) Parties should file suggestions for timeline
2) Case begins in 2023 (at which time Republicans will control the House) but
3) Judge Hanen has already made clear he will rule DACA illegal
Congress must pass legislation before the end of *this* year.
DACA case update: U.S. Judge Andrew Hanen, who ruled DACA was illegal but left the policy intact for current recipients, says there are "no more procedural barriers from this case progressing" and instructs attorneys to propose a schedule to resolve "pending matters."
How to spot bullshit.
1) There is no link to poll from Jim or
@mikeallen
in their story, nor underlying one. You can’t see the question and it’s a not common term.
2) Then skip to “Americans are open to former President Trump’s harshest immigration plans” & links to NYTimes…
The demands are centered on no Ukraine money unless
-Unilateral transit ban barring all asylum
-Eliminate immigration parole, spurring mass chaos in 2024 at border (a trap!)
-Super, Indifinate Title 42
-Mandatory Incarceration -> Remain in Mexico
“Border” is wildly misleading
Wow. Schumer just accused McConnell of “hijacking” the briefing. Schumer says instead of asking the briefers a question, McConnell called on Sen. Lankford to give an update on the border talks.
In her last debate,
@RepSusanWild
stated clearly that she wanted a pathway to citizenship for Dreamers. Her opponent dodged, and the Congresswoman pressed again that unlike her opponent, she had a vision and a plan.
@davidfrum
I have a serious request:
A really important and helpful thing here would be for you to push back when people like Vance and others you know in the restrictionist movement use white genocide, replacement theory language. You all know each other and its the same horrid language.
Rep Phillips would “make people who need to claim asylum do it from their home countries”
This is the exact opposite of what asylum is. Practically speaking, this would‘ve meant forcing our Afghan allies to wait in Kabul after it fell into Taliban control & apply from there 1/2
Just an incredibly important item from the DACA rule (page 24).
Only 3% of the 16,361 comments were in general opposition. Only 3%.
It’s an incredibly good and very popular program and that some people are trying very hard to end, very soon.

Good morning. Here’s a quick thread on some (of the few) meaningful, tangible steps the US and Americans can take to support those seeking refuge in the wake of Putin’s horrid invasion of Ukraine—in terms of direct support and immigration/refugee/asylum policy:

Good morning. Quick question for folks!
If you tweeted about the SF DA race, are you weighing in here? FWIW I don’t know if the ration is 10,000:1, but I would bet its 1,000:1?
If DACA ends, then without legislation, here’s what happens: each & every day, Monday through Friday, a new group of 1000 DACA recipients loses their job, for two years. Again: thats 1000 new people a day, every day, for 730 days until its the full ~620k purged from their jobs.

This is a must read from
@mjs_DC
on the policy of the DC criminal code rewrite — which was, again, the result of a 16 year process and a common sense set of reforms similar to those done in 37 other states — and states that have seen crime go down after.
So Biden does a border drive-by today, pretending for a couple hours to care about the crisis he created there.
We must force him to secure the border — and then, go further. It’s time for a total immigration moratorium.
Dems really have to find a way to communicate that one key to a stable, orderly system is *more* legal immigration, not less, that a well managed asylum system is *possible.* Stop validating the GOP frame that the only answer to disorder is restrictions.
Great work by those continuing to work to end Title 42 and build an orderly and humane system to manage forced migration and who were talking to offices leading into tonight, and tonight.
NEW — This is a huge win; a clear validation of the legality of these programs (parole has been in use for 7 decades) and comes after the bipartisan affirmation
around the bipartisan border of these programs.
JUST IN — In a surprising ruling, Judge Drew Tipton dismisses a Texas lawsuit against a Biden administration policy that allows up to 30,000 migrants from 4 countries to fly to the US each month if they have US sponsors.
Tipton said Texas failed to show it “suffered an injury.”
NEW: the President issuing this long-awaited rule so people can live healthy and productive lives is good news for DACA recipients and all Americans. We urge the President to take more action to ensure Dreamers and others--like the spouses of US citizens 1/2
Oh please man. People who are married to a US citizen and have been here about 2 decades on average — who have a pathway — may get a slightly less long one.
You have a podcast but would have someone on to talk about what this actually means for their family?
Applying Title 42 to unaccompanied kids is (and sorry, twitter has character limits) an anti-septic euphemism. It means a 9 year old—or all kids under 18–who tries to seek asylum will be denied even a hearing and be immediately deported. The appeal should have been filed Monday.
We reject the false concept that creating and maintaining working, legal pathways that allow people to come to the U.S. safely need to be held in some sort of feigned balance against eliminating the fundamental right to seek asylum.”
That’s just a very topline though.
This is an excellent write-up from
@brianbeutler
on the mistake to overturn DC’s criminal code re-write, putting context around it from past years and years ahead.
Title 42 was an inhumane and horrid policy in 2020. It is today. It has been since then an effort to eliminate the ability to people to apply for refuge in the US—it was not and has never been about public health.
End Title 42 now.
Ok!
Here is a thread our analysis/statement on the new DACA rule (link here).
To start, we want to communicate to DACA recipients & their families what this does and does not mean, with a note of caution given the misleading information circulating 1/…
Reading now but TOPLINES:
1) As expected, Judge Hanen (very wrongly) again ruled DACA is illegal
2) Renewals for existing DACA recipients can continue (he could not touch the stay)—so status quo holds
3) Now goes back up to 5th Circuit to rule on merits & stay & eventually SCOTUS
BREAKING — Judge Andrew Hanen again declares the DACA program for "Dreamers" illegal, striking down a Biden effort to codify the policy into a federal regulation.
Hanen is keeping DACA intact for current recipients, allowing the government to process renewal requests.

NEW:

statement on today’ s historic announcements to keep American families together:
Today’s steps can provide transformative relief for a half million spouses of US citizens, who have lived in the US for 23 years on average, as well as so many Dreamers —> 1/3
Update just now on schedule of 5th circuit DACA case (not anything unexpected) - 5th circuit responds to DOJ request & says they can submit supplemental briefs, but must do so by next Thursday. Very fast turnaround.
Decision could come as soon as Sept. 1/2
It is very good that President Biden’s campaign is putting earned and paid behind their efforts to remind voters of the horrors of President Trump’s zero tolerance family separation policies - policies he and his campaign remain too scared to admit they will resume.
As many have importantly noted…today is the 10th anniversary of when USCIS first accepted DACA applications. This has been a transformative success for nearly 1 million Dreamers, and benefits tens of millions of Americans in their families, communities and workplaces…1/2
Impt:
1) hundreds of thousands locked out of DACA thanks to Pres Trump & courts
2) No one is getting DACA anymore
3) There isnt a way to currently get out of 5th circuit stranglehold to change that
5) So lots of HS & college grads graduating w/o protection & work authorization
Ever since Trump and Judge Hanen halted DACA, hundreds of thousands of undocumented Dreamers who have been graduating high school and going to college have been locked out of the program. We are hurting ourselves as a nation by not providing them a way to fix their status.
“Multiple things can be true at the same time: the Biden Administration’s creation of new legal pathways that will protect vulnerable individuals is a critical and positive step; expanding Title 42 is entirely wrong; and we strongly oppose the proposed policy…
@brianstelter
@bariweiss
this is a really bad line. We’re at 3000 daily deaths. We can be exhausted, can point out its not 2 years ago & we can make hard decisions (like the incredible value of schools) but that requires investment designed to protect one another. This comes off as dismissing math death
To this very impt point…the current administration has had Title 42 in place longer than last one—and it is the official, communicated stance (on the record) that this is CDC’s call. Just bc people don’t believe that to be true doesnt mean it should not be a daily question.
Seconding folks who would like to see a question about Title 42 at this briefing.
It’s been in place for nearly 2 years. DHS says it’s 100% CDC’s call. CDC has literally never mentioned or defended it to press.
