@AllanBlutstein It's notable how most courts considering clawback previously (pre-HRDC, I mean)--and there were very few, in the grand scheme--did so *without* serious engagement. I think the DC Cir rightly found such caselaw to be unpersuasive.

@AllanBlutstein I don't have a problem w/agencies *asking* for docs back. I do have a problem with attempts to use judicial process to enforce involuntary clawback. Agencies can't (and should never have been able) to do that. That's really what we're talking about here.
