Plenty of valid responses pointing out that Congress doesn't seem interested in its actual job anymore. But (1) There's no other option if we want to remain a constitutional republic. And (2) we need to make them. Enforce nondelegation, shrink the admin state, and make Congress do its job. As Congress's job changes people who don't want that job will move on to jobs they're suited for. And others will step up. Change the job description, change the applicants.
There are absolutely very real threats of abuse of power - and especially to civil liberties - by the executive branch. The answer for this problem is not to empower others in the executive branch. It's to move power OUT of the executive branch and especially to Congress/states.

A lot of people dunking on this, but let's review a little history to explain how we got here and why the ACLU is correct. In the old days, we used to have something called the "spoils system," where the President would appoint party loyalists to government jobs. So a Republican president would appoint Republicans to run the government and a Democrat would appoint Democrats to run the government. This was considered inefficient because you had to change all the government jobs whenever there was a new party in charge. So in the late 1800s, they replaced the spoils system with the career civil servant system, which ensured that no matter which party was in the White House, the federal government would always be run by Democrats.
