DOJ must nip this. DOJ needs to impanel a grand jury this weekend and indict James and the Judge. Period full stop 🛑!!!! DOJ has legal grounds to investigate and prosecute such a judge for criminal misconduct and abuse of power. As you know better than anyone else - this is an illicit and illegal order and therefore the executive branch can ignore it. A judge who knowingly issues an unconstitutional order that disrupts the separation of powers and the proper functioning of the executive branch could face criminal prosecution under federal law (18 U.S.C. §§ 241, 242) or be impeached and removed. Judicial immunity does not apply to actions taken in clear absence of jurisdiction or in violation of constitutional rights (Stump v. Sparkman, 435 U.S. 349 (1978)). Separation of Powers Doctrine (Article I, II, III) •The judicial branch has no authority to override the executive or legislative branches except in constitutional cases. •Marbury v. Madison, 5 U.S. 137 (1803): Courts cannot exceed their constitutional jurisdiction. •Youngstown Sheet & Tube Co. v. Sawyer, 343 U.S. 579 (1952): Reinforced that courts and the judiciary cannot seize power outside of constitutional limits. Conspiracy Against Rights (18 U.S.C. § 241) •If the judge conspires with others (e.g., prosecutors, government officials) to issue an unlawful order that violates constitutional rights, they could face prosecution under 18 U.S.C. § 241. •Precedent: In United States v. Price, 383 U.S. 787 (1966), the Court confirmed that state officials could be held criminally liable for conspiring to violate civil rights. (That would be James and Judge ) Abuse of Power & Color of Law Violations (18 U.S.C. § 242) •Federal Law: Under 18 U.S.C. § 242, it is a crime for any official, including judges, to deprive a person or entity of constitutional rights under color of law. •Judicial Overreach: If a judge knowingly issues an order that violates due process, suppresses constitutional rights, or undermines the separation of powers, they can be prosecuted. •Precedent: United States v. Lanier, 520 U.S. 259 (1997), held that judges can be criminally liable under § 242 if they act beyond their authority and violate rights. Violation of Oath of Office •Constitutional Duty: Judges take an oath to uphold the U.S. Constitution (Article VI, Clause 3). •Breach of Oath: Issuing an order that knowingly violates the Constitution or interferes with another branch of government constitutes a breach of duty. •Precedent: In Cooper v. Aaron, 358 U.S. 1 (1958), the Supreme Court ruled that state officials, including judges, are bound by the Constitution. Any deviation from it is unlawful.
