@BigEnergyDad @alphatipsy @ChuckTod_Goatee @shipwreckedcrew Lots of blame for the helo crew. And I also think that if tower had used a standard traffic advisory the accident might have been avoided. “Do you see the CRJ” does not tell me the same as “Traffic, 12 o’clock, 1 mile, opposite direction.”

@TPakk10 @shipwreckedcrew @WisenbergSol Going from memory here, but if I recall Franks was only about affirmative misrepresentations. In the years since, some lower courts have taken Franks’s logic and applied it to knowing or reckless omissions, but IIRC with some variations between courts.

@sentdefender @Ethiosalem That. But I'll add that the Army is currently classifying her as DUSTWUN. Which is interesting.

@Distant_Warrior @DaleStarkA10 True that the help blew the ceiling. Also true that the ATC traffic advisory call was non-standard, which might have been a factor.

@shipwreckedcrew Yes. Rule 1.4(a) duty to inform about the offer and Rule 1.4(b) duty to explain the options. (And — if it’s crossed the threshold of becoming a “formal” plea offer — potential IAC under Missouri v. Frye.)

@KevinWeigh @ReeveSwainston @shipwreckedcrew 1. True. 2. As I read it, he stipulated that he possessed the firearms in the safe, regardless of who owned them. 3. Interesting question, but I have a feeling that argument won’t work.

@pitterpatter31 @shipwreckedcrew Yeah. In the 9th Circuit, he can be on the hook for "joint possession" in a shared home if the gov can prove that he knew of the weapon and "both the power and the intention to exercise dominion and control over it." She'd probably have to lock them in a safe he can't access.

@pitterpatter31 @shipwreckedcrew As I read it, he admitted that he possessed the firearms and ammunition.

@ScottAdamsSays A court case in Alaska in 2019 said that Trump couldn’t un-do a similar order by Obama. But it was never analyzed by an appellate court because by the time it was on appeal in 2021, Biden had “un-done” the “un-doing.”

@MostlyPeacefull Probably because the show wanted to redact names and also wanted to forward the email to FBI. You’re looking at a screen capture of the email with names redacted. One way to do that is to hit “forward” and then highlight the names with the same color.

@SMB_Attorney I bet the first step will be limited access express lanes on certain highways, similar to what some places have done with HOV lanes and automated tolls. But these would be only for self-driving.
