Yesterday, I acted as an Arbitrator in the Vis moot competition between MUK and Cavendish University on International Commercial Arbitration . The participants were exceptional and brilliant to say the least especially in a relatively nascent area in Uganda. The future is bright!

Uganda is taking on Kenya in a first of its kind inter-state dispute at the East African Court of Justice. This is in regard to the petroleum-oil importation tiff that has been in the news between the two countries. I hope this is the start of more of these disputes.

I have spent the better part of my morning reading some western media articles about the sporting spectacle last night. To say that those guys write beautifully is an understatement!
Interesting debate in Parliament today over the Sports Bill; Government through the Minister of Sports tries to block Magogo’s Private Member’s Bill, but the Speaker insists that it must be laid before Parliament. Government says that the Bill was harmonized. 1/2
This week. The Physical Activity and Sports Bill, Uganda’s so-called “sports law” clandestinely resurfaced a couple of weeks ago and according to my hunch will soon become law. My two cents on the law. I have a lot more to say, perhaps in a sequel.
I pay tribute to Hesgoal today. Sports because it’s societal role, a public good that must be enjoyed by all creates an interesting dilemma for the strict application of Intellectual Property Rights. We need a balancing act. Forgive a small typo somewhere.

The National Payments Act, 2020 is now law and is supposed to regulate the Fintech industry. Is Fintech only about "Payments"? What about insurtech, What about credit-tech? What about invest-tech? Etc. First problem with that law.
We need that Supreme Court Presidential Petition. We must never stop believing in our institutions despite the politics. Let history be the Judge. From a lawyer's view, I look forward to some great litigation skills on display and lessons.

A constant feature in Kenyan litigation especially during these Presidential election petitions is the fact that some of their top legal academics seem to also be serious litigators. Something rare in Uganda.

The erudite Judge discouraged the practice of generally lumping up image rights with other employment and labour rights and obligations in an employment contract. Court was emphatic in stating that the image rights of players are personal!
This case is a positive development and good for Sports law jurisprudence especially after the last Image rights case was so near yet so far, Onang & Others V Roofings.
The average age of the lawyers on either side in the Kenyan Presidential petition stands out. In Uganda, I could be wrong, many 60 yr old lawyers have since more or less moved on from active legal practice. An 80+ Nowrojee, Muite, almost 80 year old Orengo et al are still at it.
The IBA recently released a report indicating that over half of young lawyers will quit the profession in the next 5 years for various reasons: Poor remuneration, Mental health, Toxic work culture and technology. An important read.
In as much as I appreciate that the AFCFTA is a long-term project with least developed countries like Uganda given up to 10 years to liberalize upto 90% of their tariff lines, we must still ask "Is Uganda ready?"
Those controversial clauses; 49 and 50 of the Magogo Sports Bill raise the age-old debate which I have explored in my column quite a bit; who owns sports? what amounts to being a sports stakeholder? How far should commercial interests in sports, a public good go? 1/2

Justice Mubiru settled the debate by stating that because Image rights are derived from the Constitution under the right to privacy as opposed to Copyright which has its own statute, Image rights prevail over Copyright.
Kenya's Sports Act is a strong one but even it has perhaps failed to rein in Nicholas Mwendwa. Sports duo governance mechanisms as public and private will forever clash. This is a fight that I have previously written about

We have a Competition Law now (it is a bit meek in my view, nonetheless we shall work with it). There a lot been a lot of anti-competitive practices in the sports sector. We have guidance from elsewhere.

I recently met the great Prof. Melaku Desta of UNECA/ Africa Trade Policy Centre. Prof. is a mentor of mine, top International Trade/ IEL lawyer and academic and certainly one of Africa’s best legal minds. Major takeaway from our conversation; “Invest in the longterm”.
One of the most tired discussions on Ugandan TV is from Ugandan musicians "There is no law on Copyright", "The Copyright Law is not strong enough". This is even after all these initiatives from URSB, UPRS, Salim Saleh etc to create awareness. You have to make the law work.
The case also pronounces itself on a couple of other things but among the sub-plots was the Court's pronouncement on the tension between Copyright and Image rights when it comes to these Image rights cases.
