Excellent read. And such an important issue. Congress never wanted common law immunities to apply to Section 1983. The Court has absolutely been wrong about this since Tenney, when it didn’t even look at the original text & it just got worse in Pierson, Imbler, & Harlow.

Via this morning's Orders List, #SCOTUS has now relisted both of @IJ's #WrongHouseRaid cert. petitions for a THIRD time. That could mean several things, but it's a little curious that the cases are in a group of 15 cases that have been relisted three times. We keep waiting.

Another day, another cop getting qualified immunity. Calmy ask "why am I being pulled over" but "shift your hands"? It's reasonable for the cop to grab you through the window w/in *6 seconds*. React in any way? "All the more reasonable" to use force and escalate that force.

My favorite was when the SG argued that our client’s $2 million fine for not filing a one-page tax form was not actually a “fine” because it wasn’t “a form punishment.” 🙄
Speaking from experience, nobody is cynical enough to avoid being shocked by the disingenuous arguments made by government lawyers. Please be shocked! And stop giving the government or its lawyers the benefit of the doubt. Time and again, they’ve proven unworthy of your trust.

@EFStephenson2 @IJ Both. @IJ’s client is in Georgia. But the same thing happened to a family in Kentucky. The 6th Circuit opinion that came out today discussed the latter.

Regardless of the government policy, I’m a big a fan of *not* hiding things from parents. (Take NJ, where the state was secretly storing kids’ blood in a gov’t-run database for 23 years.) When the government starts hiding things, it’s not usually a good thing.
