🚨AZ Representative @MatthewGress files first-in-nation bill HB2862 requiring school boards to regulate universal school-based mental health services using counselors, social workers - MAJOR PARENTAL RIGHTS AND TRANSPARENCY WIN: Comprehensive 4-page bill addresses the need to regulate school-based mental health programs: ✅Acknowledges that school-based mental health support services implicate fundamental parental rights to make decisions concerning the upbringing, education, health care and mental health of their children. ✅Reinforces local control through elected governing boards by explicitly asserting school board authority to determine whether a district shall offer school-based mental health services. ✅If approved by board, provides mandatory framework for services based on the principles of informed parental consent, transparency and parental authority. ✅Obligates schools to disclose material information related to the support services. ✅Obligates schools to disclose qualifications of school personnel - if not licensed by a health regulatory board, district must disclose providers are unlicensed. And much more: ✅Applies to "universal screening" of all children, must be voluntary and parent-approved with full disclosures ✅Allows parents to withdraw consent to services anytime. ✅Mandates school notify parents when referral for mental health is made ✅Prohibits use of automatic, click-the-box, "opt-in" consent forms to receive services ✅Mental health personnel must disclose reasons for referral for an intervention, the methodology of the intervention ✅Mental health personnel must provide IN ADVANCE all surveys, tests, assessments performed as part of intervention ✅All records of the mental health intervention must be made available to parent - including any tracking software maintained by school to "monitor" mental health ✅Exceptions proposed for crisis interventions, self-referrals involving conduct triggering mandatory reporting laws ✅Establishes incentives to comply by specifying that violations of this law may result in disciplinary action and/or a lawsuit for violation of fundamental parental rights. 1/n
