Am glad the US is defending Israel as well as int’l shipping wrt targeting Iran-backed Houthis, & as my students learn in our national security law course, Congress approves executive action in many ways such as funding; yes AUMFs can be helpful but not necessary per SCOTUS for fulfillment of legislative war-making “declare war” role

The coordinated operation by Israel against the ICC is…shocking. They treated the ICC like an enemy state, albeit without the lethal targeting. Has the US done anything similar? The covert actions, that is. Obstruction of justice in contravention of rule of law. Instead of (or in addition to) fighting ICC jurisdiction on legal grounds, the resort to unlawful obstruction is revealing regarding how tenuous adherence to rule of law on the global stage truly is. The unraveling continues.

The US is simply wrong on this. And interestingly, some of us who taught IHL (LOAC) to US warfighters included precautions in attack as a separate principle … as we saw through the Pentagon obfuscation.
Niche IHL 🧵: 1. The United States takes the idiosyncratic view that precautions is an implication of proportionality, not a fundamental principle in its own right. On Friday, it claimed that "Most States do not recognize an IHL 'principle of precaution.'" Unlikely.
