I sometimes forget how unpopular "getting people out of psychiatric hospitals & making sure they can refuse medication if they want to" makes me. I got in touch with an old friend the other day. He was really friendly until I explained what I do. That was it. Not another word.

When you see a lawyer faint away at the podium during a live-streamed inquiry, on the heels of the OLRB marathon where counsel litigated through 21 of a consecutive 30 hours, we should start asking ourselves what we're doing to our bodies & minds and why. We have to do better.

Wouldn’t it make sense to set up vaccination clinics in schools starting today & boost all teachers & school staff while also expanding eligibility to teens for boosters, and boosting them now? Wouldn’t that make schools a lot safer for many by the time in person school reopens??

My daughter said the same thing. That she could have used grade 13 this past year instead of being thrust into university. I would support bringing it back. The kids need the extra time right he now.

I would 100% support bringing back the Grade 13 year, given the situation in which we find ourselves. I honestly feel that many students in high school right now might benefit from the extra year to get their ducks in a row.

30 years ago today, my best friend died in a tragic car accident. I was driving the car. She was the closest thing I had to a sister for my entire young adult life at that point. I have struggled with PTSD since the day of the crash. Today I open up about it for the first time.

My not yet 2 years out associate is arguing her first full appeal in the Court of Appeal on her own today. I will be 'with' her on 'zoom' but she is in charge of it all, rather than a small bit of a less important argument. She will be incredible. I will beam with pride. #elevate

According to Quick Law, I am headed to the SCC for the 10th - & possibly (fingers crossed) 11th time. Given my arrival in this country as a refugee, growing up in abject poverty, all things considered, I'm doing OK. QL also says 165 OCA appearances. Best part: 1 whole OCJ outing!

I’ve had a very difficult day. Client who always calls me at home calls me tonight. He can tell from my voice I’m not myself. “How can I help you?” He asks me. From inside psychiatric detention. Made me cry. My clients’ humanity moves me. They worry about ME! My stupid problems..

1987-1990 I paid $1300 a year at U of T Law school for essentially the same education now costing $40K/yr. Some of the same profs. Some of my students now have >$200K in loans. This is untenable. It's price gouging. The schools don't know what to do with all their money. #unfair

I heard this story the other day. Fitness hearing in Zoom Court. Client is "unfit, labelled with schizophrenia." Deaf. Uses ASL & deaf interpretation to communicate. Is talking throughout hearing. Judge instructs the interpreters to stop interpreting. This = Epitome of silencing.

1460 days smoke free. There should be a chip for this too. Nobody loved smoking cigarettes more than I did. Still proud of myself for kicking the habit. It was not good for me or the people who love me. This is one thing to celebrate today. Cheers to a much brighter 2022 for all!

28 years ago today, I was called to the Ontario bar. It was a massive milestone. I had just survived a lethal carcrash, a divorce, a firing & more in the year before, all at 25. 9 years ago today, my father died. Pics are then & now(ish). Missing it all. My proud dad & the gowns.

People assume that representing clients in psychiatric detention must be horrific because the clients are a particular problem. The clients are the best part. Everyone else is often difficult, but clients can provide pure moments of joy. Like when they testify and nail the doctor

Mothers of small children who are practising law right now deserve a medal. I have two older teens. It's all I can do to get up for the next day every day. Let's face it, some days I don't make it. If my kids were little, I couldn't manage. I am in awe of all with little ones now

When my daughter was 10 weeks I argued my first case at the Supreme Court of Canada. She obviously tagged along. It was a long night & day with feedings & she was ejected from the courtroom for crying when I started making submissions. But she returned 17 years later for my 10th!

Of the 57 thousand Ontario lawyers, 3000 accept legal aid certificates. Fewer do so regularly. Those lawyers acted on 100 thousand matters in 2021-2022. That's an ENORMOUS amount of work done by less than 5% of Ontario lawyers. We deserve a medal, people, an actual medal. 👏

What an extraordinary day of litigation I was privileged to be part of today. It's not often I am moved to the point I can't necessarily trust my own voice not to crack. Dozens of lawyers worked pro bono or on legal aid to represent vulnerable client groups today. They were great

I'm about to start hiring articling students again. I can tell you that paying minimum wage will not draw students with crushing student debt to a social justice articling position. Those students will take positions they hate that pay them $100 K because that's what they need.

So an accused is refusing to wear a mask and they put him in a separate room for his bail hearing. When my detained client refused to wear a mask to attend Court, his review of his severe restriction of liberty was cancelled because he would put the public at risk in courthouse.

Call at home from a nurse at a big psychiatric hospital. One of my oldest & dearest clients is in seclusion. Asked her to get a hold of me. I say: OK, put him on. He gets on the call & the first thing he asks me: "How are you??" My clients break my heart. Their humanity moves me.

20 years ago this month - the actual anniversary was last weekend the 15th - I argued my first case in the SCC as amicus curiae in Starson v Swayze. Turned out kinda important. I 1st argued the case at the tribunal level in 1998. First child 10 wks old came along for the feedings

Defence lawyers are treated poorly too often. Opposite me are psychiatrists, hospital lawyers & the Crown. They're given every courtesy, all the time in the world, to prepare reports or submissions. I'm expected to work nights & weekends. If I protest, nobody takes me seriously.

Some fun news. Tonight I learned that I have been selected to serve as the Women's Director for the Criminal Lawyers' Association. I am therefore back on the Board of Directors of the CLA after a brief one year's hiatus. I had been a Toronto Director and MH Committee chair prior.

During one involuntary committal hearing, a psychiatrist party who was being aggressive in 'cross-examining' my client learned an important lawyering lesson the hard way. He asked my client: "Are you delusional right now?" Her: Well if I am, I'd be the last to know, wouldn't I ?

I am growing weary of reviewing transcripts with open ended questions to testifying doctors, such as: "How would you describe my client's symptoms of schizophrenia?" Here are some thoughts on how to cross-examine any witness. Goes equally for expert witnesses, like psychiatrists.

My firm of seven is roughly half and half Jews and Muslims. I asked for a team meeting yesterday on Zoom to give space to everyone to simply express how they're feeling. I heard about concerns of other young lawyers out there fearing employer backlash for any public sentiments.

My 18 year old daughter just announced she doesn't want to be a lawyer, because, and I quote: "I want to have a life." I cannot think of a more damning indictment of all that I am. To be fair, she's just watched me sit in front of my laptop on our couch for a year without moving.

I'm looking around worrying that young women can't see it when they're being controlled & isolated in our profession. It's really very similar to abuse in a personal relationship. If your work is consistently taken for granted & you're not recognized or rewarded, move on and up!!

Rosie DiManno’s wrong. I have lived off this park since 1992, renting for 10 years, owning a condo & then a house. Encampments were never the nuisance in this park. Anti-vaxxers/maskers were/are. The differential police presence / enforcement was striking, upsetting & disgusting.

Client's mother died just a few days after being diagnosed with an illness. On the day she died, client got very upset. The psychiatric hospital's response to him yelling "My Mother Died Today" & then not wanting to talk about it was to lock him into seclusion. Imagine the pain.

Just won a client the right to smoke pot while under the Review Board!! Not medically prescribed but recreational. I am thrilled for this client who has an ABI and benefits in so many ways from moderate daily use. Hard fought battle. For now, a big “W” for this vulnerable man!!!

I've been interviewing articling students for years. None of that has prepared me for the caliber of applicants we are seeing now. We received more than 35 applications. So many bright, accomplished & solid candidates. Some are brilliant & exceptional. All are jobless. Worrying.

This beautiful 5 YO reportedly insisted on bringing my book to the kindergarten “show and tell”. She explained I live “in another country” where I get people out of hospitals. I really wish I’d been there to see the preschool teachers’ reaction. The other kids brought stuffies.

Our client said he had been maligned on the internet with falsehoods spread about him thousands of times re-shared. He got labeled as paranoid & schizophrenic for that. He & we, as his lawyers, begged his psychiatrists, quite a few of them, forensic psychiatrists, to look it up!!

17 years ago my client took the life of another person. He was young & very unwell at the time. Found Not Criminally Responsible as a result of mental disorder. I've been his lawyer ever since. Through many ups & downs. Today I got to call him up and tell him he was a free man.

From last Thursday to next Thursday, I have four appeals in the Court of Appeal for Ontario & one in the Supreme Court of Canada. That's 5 appeals within 10 business days. I actually had not looked ahead to next week until just now. Not easy, BUT every appeal I do is a privilege.

31 yrs at the bar, I've NEVER seen lawyers in such utter distress. A big chunk of Ontario lawyers are not functioning at all. Professional misconduct level incivility is rampant, unresponsiveness is the norm, deadlines are optional. COVID + War unprecedented stressors. SOS

People die in institutions all the time. The false dichotomy is asylum safe, community kills. Not so simple at all, indeed. Very few people draw benefit from involuntary lockup. Some people seek admission. Those people should be admitted. They’re not. The “system” favours force.

I've heard involuntary hospitalizations framed by clinicians as a choice between potentially traumatizing a patient and potentially letting a patient die. I appreciate why it may feel that way for a clinician but that is not actually the choice these laws create.

Today would have been my parents’ 58th anniversary. I was lucky to have them as long as I did. This was my law school graduation at the U of T law school in 1990. As Holocaust survivors & refugees to Canada from communist Hungary, this was among their proudest days. I miss them.

I'm fortunate in that I genuinely love my job. Despite nearly 30 years of purely legally aided files & the attendant stressors of all that, I still enjoy representing clients with mental health issues. My enthusiasm for the privilege of advocating for them has never, ever waned.

The simple observation that persons with serious mental health issues are also human is causing shock-waves throughout the legal profession this weekend. If that in itself doesn't make you stop in your tracks & immediately grasp the depth & breadth of ingrained prejudices, right?

I walked into a hearing room full of people including 5 adjudicators only to hear the older male Crown respond to my “hello” with “Oh, Anita, I didn’t recognize you with your clothes on.” Turns out he was my aquafit instructor at the local Y.

Sullivan and Chan. One of the most intellectually challenging cases of my career. And among the most important for the criminal law. Couldn’t have dreamed of a better team. My casting of this one was spot on. @martelldefence leading the way for our client the Empowerment Council.

Hot Take: Courage is the single greatest attribute of the titans of the profession. Those who aim to please everyone all the time, not rock the boat, smooth over any conflict, are useless to clients & colleagues alike. People pleasers make the worst lawyers. Speak truth to power.

10+ hours of research to confidently assert "there is no case that does X" -which is what I wanted to find- ie nothing. Searching for nothing is a hugely anxiety-provoking task. You're constantly opening cases with one eye half open just in case that's the one. That ruins it all.

I've posted a 5 star review on Google for @CarymaRules because she is an excellent young lawyer who happens to be a young woman of colour. She has been on the receiving end of a lot of sexist, racist ill-informed vitriol, and a concerted effort to hurt her

33 years ago today I got married thinking that was a good idea - I was 23. It lasted about a year. Seemed like the end of the world at the time. I can barely remember it now. Currently happily unmarried to the father of my two amazing children. 27 years of unmarried bliss. 💜 ♥️

A great Judge once told me: “It’s bad enough when you have a good lawyer in front of you who’s not prepared, it’s worse when it’s a bad lawyer who’s not prepared, but the absolutely worst thing in the world is a bad lawyer who’s extremely well prepared.” Words to live by, friends

Call me naive, but once someone treats you with enormous disrespect, there's no obligation to continue to mentor them, support or include them in all you do. There's barely any space for ordinary professional courtesy, because they've not afforded you the same thing. My view.

Shout out to counsel opposite in our appeal today who was a total class act. & made me laugh with her response to our Judge at day's end. It's lovely when you have accomplished advocates on all sides making thoughtful arguments respectfully. We can agree to disagree, collegially.

The psychiatric system, and in particular the forensic system, is extremely frustrating. It is unfair to many clients whose legitimate fears and concerns are labelled as 'paranoid' and 'lacking insight' or "poor judgment." And far too many people spend way too long in the system.

My mother was tortured in concentration camps. Her mother died of Typhoid in one. My father was nearly killed many times in Budapest throughout the Holocaust. His father was shot & killed in Dachau. My parents survived the unimaginable, as teens. Yesterday was hell. Never again.

Those who know and live generational trauma will understand why this son of a Holocaust survivor, grandson of a man who did not survive a Nazi death camp, is currently sitting on his couch crying. 😢

Law pro-tip: If you were taught to present your case in a particular way, that way is likely comfortable for the old white man. What's "traditional" is bogus in the same way as what is "objective." Nothing wrong with being interesting, charming, funny or kind. In your own voice.

Just sitting here reviewing a file for a client I’ve had for 25 years nearly. Under the ORB the entire time. Detained in hospital most of the time, with some years out a while back. Now detained again. 40 when I met him. 65 now. Offence? Utter threat. Zero violence. This is NCR.

I heard today that my old friend & cherished colleague Peter Rosenthal has died. He and I first became friends in law school at the U of T in 1987 - he at 47 was the oldest and I at 20 the youngest in our class. He was a mentor and a Saint. His work on police killings is legend.

What about this? Your @LawSocietyLSO fees are 5 x your hourly rate. That way, those billed out at $1000/hr pay $5000. Those with legal aid practices like me pay $700. I bet you can figure a formula where the budget is not affected, all hardship is eliminated & system is fair.

I was representing a client at a fitness hearing. After the psychiatrist testified to say my client was unfit, I asked for a recess to speak with my client. The adjudicator said "you can speak to him after the hearing." I said: I want to speak to him now. It's the client's right.

#lawtwitter is an interesting place. In my less than a year of activity on this platform, I've encountered 99% positive, supportive colleagues, made new friends, created new collaborative professional relationships. There's the 1% you block, who nonetheless stalk you daily. Bless

Many of my clients are afraid of the vaccine. This is because the injections they’re used to getting are forced on them & often make them feel sick. I spend a lot of my time gently persuading them to accept the vaccine. I think I’ve managed to make some headway. Plz do your part.

If I had just one litigation / advocacy tip for junior counsel, it would be: "Don't take no for an answer, if it doesn't make sense." Hospital just told us they can't facilitate our client's access to Zoom unless he has his own tablet. I said: "Why not?" They said: We can do it.

This week I experienced the horror of an unmuted Judge swearing under his breath while I made submissions. I didn't know what to do so I said "OK". Unclear if he was aware, but I was, & remain, humiliated, as the Crown & colleagues heard it all. No clue how or whether to address.
