It allows states to decide whether to permit it or not, and to place the regulations on it they deem appropriate.
Some will take the TX/MS route...others the CA/CO route..

Throughout that entire thing you omit the central point of the Senate: it provides equal representation to the States, not the populus. The House does the latter. NY has the same status and power as RI in the Senate.. critical as a Union of equal states.
