Because he's the Respondent - the one who has been brought to court involuntarily (I know, I know - but that's the law answer) and the Court will always try to err on the side of equity (fairness). Electing not to testify is not an "error" and therefore couldn't be appealed.

I worked for a French company that believed so strongly in employees performing civic duties without using vacation, sick time, or PTO they just excused us with pay for as long as it took. Just saying: people should start demanding that as a perk.

Respectfully, 1) this is the microview of the ruling (it only applies to "creative" endeavor), but 2) expect every bigot in America to now claim that what they do qualifies as "creative" so that SCOTUS may broaden the scope of who may "legally" discriminate.
