Hot of the presses in the California Tax Lawyer, “A Critique of the Cryptic Rules for Taxing Crypto.” Thank you to my co-authors @jcreech3 and Dennis Leonard for the article and for presenting the paper with me at the @CLATaxation Washington, DC, Delegation!

With the “carried interest loophole,” private equity partners earning $100+ million only pay a 23.8% federal tax rate—as opposed to the 37% top rate on typical worker compensation. Although unsuccessful with the 2017 TCJA, Trump intends to eliminate the preference in 2025.

If you commit tax fraud and rap about it on social media, there’s a good chance that the US Dept. of Justice will catch you. Rapper “Mr. Chaketah” and six others were indicted for an ERC fraud scheme involving 8,000+ returns and $600+ million in credits.

Friend: Can you help me out with this police citation? Me: I’m a tax lawyer, not an expert in criminal law. Friend: Fine, I’ll just ask John. Me: He’s an M&A attorney.

I can't tell if the authors were joking or not: "One of the key accomplishments of TCJA was that it significantly simplified the tax code."

LA Wildfire Victims: With 10k homes destroyed, will property taxes be protected under Prop. 19 if replacement construction can’t be completed within 2 years? CA Gov.: No problem! RTC §70.5 gives you up to 5 years. And that deadline could be extended—similar to the Woolsey Fire.

A big tax perk for certain political appointments is the ability to defer taxes while diversifying investments. Under §1043, you can sell a highly appreciated asset, invest in a fund, and not pay any capital gains taxes until you sell that fund. The rule even applies to trusts!

Just like every year for the past 20 years, HR25 was recently introduced in Congress to repeal the income tax, abolish the IRS, and enact a national sales tax. The percentage chances of the bill passing this year are in the low to mid-zeros.

If you’re just getting started with a career in tax, don’t worry if everything seems overly complicated and confusing. It will still feel that way decades later.
