In the UK, the general anti abuse rule in the Finance Act 2013, though there’s debate on whether that’s contrary to DTAs on the basis that there’s international acceptance of anti abuse rules. There’s a clearer example from India I think, though I don’t have the reference to hand.

@HCH_Hill I’m not sure if @yuanyi_z has any better suggestions for improved terminology. I don’t much like ‘international custom’, I don’t think it captures the full scope of what PIL is.

@HCH_Hill Using ‘law’ for both is old and established, hence the aridity. I agree some people try and draw inapt analogies to extend the scope / force of PIL further than it should go. But it has been considered a form of law for a long time.

@yuanyi_z @charles_forsyth @SpartanRedux Hence how you get the situation that the U.K. (and other counties) have breached international law by overriding taxation treaties with domestic statutes. Perfectly legal domestically, but still a breach of international law.

@Mendelpol I don’t disagree - I was just making the point that in theory (I suppose) the government could have an (international law) obligation to punish private citizens for Twitter posts directly inciting genocide, under the Convention.
