@AbdullaMuizzu @saffahmohamed See! That sort of trivia detracts from the issue at hand which is the Minimum Age of Criminal Responsibility, its impact on crime and its alignment with shariah.

@saffahmohamed I don’t deny it. But I try not to focus on personalities when expressing myself. It distracts from the issue.

For this reason one can only legislate based on an average age. This is what Parliament has done in the past and the position in law. The MP is entitled to his opinion and to advocate for lowering MACR. But current law does not conflict with Shariah.

Fourthly, there is a view in Shariah law that for a child to be made liable for a crime they should not only have sexual maturity but also the ability to comprehend the nature of their actions.

Thirdly the MACR in the Maldives is 15 as set by the Juvenile Justice Act. Not 18 as some taking part in the discussion have assumed. Also it is possible to impose criminal liability for children upon an assessment of their capacity to comprehend the nature of their actions.

Firstly, the specific facts of the altercation seen on video are not known. Secondly we do not know if the number of child offenders are rising and has anything to do with the Minimum Age of Criminal Responsibility. For this the MP should consult statistics.

It is open to the Supreme Court to adopt the doctrine of unconstitutional constitutional amendments and move to strike down an amendment OR alternatively the SC can decline jurisdiction to review the constitutionality of an amendment to the Constitution.

Another interesting proposal by the author is that if the incumbent who was replaced had already lost legitimacy by upsetting be partial legal order himself, changing him and restoring the legal order would not be a coup.

@zahirlein What I’m saying it’s extremely insincere to treat a complaint in the manner described above - make them file and FIR online, demand that they come in person to repeat the FIR and then proceed to decline to investigate if no in-person complaint is filed.

@zahirlein There are always precautions that all victims can take to prevent misfortune. But when it happens the police have a duty to assist. The recipient of the funds can be contacted and even if they are innocent they should return the funds. Also attempt should be made to find culprits

When the victim said they were unable to come before expiry of the deadline the case was declined. So spare us these ineffective warnings and insincere headlines. We don’t feel safe in our country because you people can’t do your job.
