All that SCOTUS need do is deny cert. That leaves the intermediate court's opinion in control of this case: granted, it would not be mandatory authority (merely, "persuasive") outside the DC Circuit. Then, this criminal case can proceed, without awaiting a ruling from SCOTUS

They could have easily said that while there is no express right of privacy within the Constitution, there are "unenumerated rights" expressly acknowledged by the 9th Amendment; and, that the court recognized privacy as one of those rights, decades ago.
