I've accused the entertainment industry of abandoning creativity and turning into boring IP management companies run by lawyers and accountants. They don't even pretend otherwise anymore.

One speaker also said (again, as a good thing) that these orders were issued and controlled by judges, with no political accountability. Hmmmmm. I guess a lot of where you stand on this stuff really depends on where you sit. From where I sit, this is terrifying.

A more eloquent statement is forthcoming from Re:Create, but here's the hot take: the USCO gets the big picture right, here, and gives useful new guidance on the copyright eligibility of works created using AI. They should take the same approach in part 3!

So it's not theft when you train OpenAI on copyrighted materials, but it IS theft when you train another LLM on OpenAI's "knowledge." I think we either need to call it all theft or none of it.

IMO the best reason AI outputs shouldn’t be copyrightable subject matter is because there’s no coherent policy reason to make them copyrightable subject matter.

Existing fair use law adequately addresses computational uses of in-copyright works and provides a deep well of precedent and foundational constitutional commitments in the copyright system, more than enough to guide courts and others in evaluating AI training.
