@wwwojtekk The point Vance is making is about the separation of powers. The judiciary doesn’t make the law (the role of the legislative) or manage the federal agencies (a role of the executive). Judges need to be mindful of respecting the roles of the other branches of government.

@billybinion Perhaps it’s the difference between deciding legitimate cases and controversies versus imposing preliminary injunctions willy-nilly based on the feeblest of theories. Sure, the appellate courts will correct them, but in the meantime it’s certainly interfering with the executive.

@MollyJongFast The real questions are (1) if a government taxes its citizens coercively, what should it spend that money on; (2) if this includes scientific research, who is deciding what is funded and why; (3) if nobody can answer question (2), isn’t pausing for critical review warranted?

@micah_erfan Can there be there no such thing as an activist judge who rules for partisan reasons rather than impartial application of the law? Hopefully this is not the case, and appellate courts can correct. Still, criticism of suspect rulings can coexist with respect for the rule of law.
