PRESS RELEASE: AAK'S STATEMENT ON THE COLLAPSE OF A SLAB AT AN ACTIVE CONSTRUCTION SITE AT THE INTERSECTION OF 3RD PARKLANDS AVENUE AND MPAKA ROAD The Architectural Association of Kenya (AAK) is deeply saddened by the tragic incident that occurred at a construction site on the evening of 11th February 2025, at the intersection of 3rd Parklands Avenue and Mpaka road, claiming one life. The AAK #MulikaMjengo team conducted a site inspection and identified structural integrity issues and safety lapses, including poor formwork, improper bracing, and a lack of site supervision. 🔹Consequently, we urge enforcement agencies to conduct a structural audit to identify the cause of the collapse and call on developers to maintain continuous scaffolding and implement strict worker safety measures on all construction sites. 📢 Developers must adhere to safety protocols to prevent further tragedies! Join us this #FridayFocus as we discuss the Enforcement Procedure for Non-Compliant Buildings in Kenya: Non-compliance in construction arises when developers fail to adhere to building regulations designed to ensure safe building practices. In Kenya, 80% of construction projects proceed without the involvement of certified professionals, posing significant risks to public safety and compromising the quality of construction. As the approving authorities for building permits and planning approvals, county governments are also responsible for enforcing compliance with the building regulations. Additionally, state agencies such as the @ncakenya and the @NBIKenya conduct independent site inspections to verify compliance with established standards. Below is a comprehensive outline of the enforcement process: 1. Site Visits and Inspection The enforcement process begins with an inspection by enforcement officers from government agencies or local authorities, such as the @ncakenya , @NBIKenya , or relevant county government departments. These officers evaluate the building for issues such as structural defects, safety hazards, missing statutory approvals, or deviations from the approved building plan. If non-compliance is identified, the building is flagged for corrective measures. In addition, the @NemaKenya also conducts site inspections by assessing compliance with environmental regulations, evaluating potential impacts, and enforcing necessary corrective measures to ensure sustainable development. This is also done before issuance of @NemaKenya licenses, upon application for an Environmental Impact Assessment (EIA). 2. Issuance of a Notice After the inspection, a formal notice of non-compliance is issued to the property owner/developer detailing the identified violations, required corrective actions, and the timelines for implementation. If construction is still underway, the notice may be accompanied by a stop-work order, suspending all activities on-site until the non-compliance is resolved. 3. Assessment and Rectification Period The property owner is given a specified timeframe to resolve the issues. During this period, they must submit rectification plans to the relevant authorities for review and approval. These plans may involve structural modifications, obtaining the required permits, or resolving safety concerns. Assessments by county enforcement officers or the @ncakenya ensure that the proposed corrections comply with regulatory standards. 4. Follow-Up Inspection After the rectification period ends, enforcement officers conduct a follow-up inspection to confirm whether the required adjustments have been implemented. If the building meets the stipulated regulations, it is approved for continued construction or occupation. However, if non-compliance persists, additional enforcement measures are initiated. 5. Further Action If the developer fails to comply within the specified timeframe, the following additional actions may be taken: a. Demolition Notice: A final notice is issued warning the developer of potential demolition if the violations remain unaddressed. b. Legal Action: The case may be escalated to the courts where penalties can be imposed and additional enforcement orders issued. c. Demolition: Authorities may proceed with demolishing the structure particularly if it presents an immediate safety hazard to the public. In Kenya, the NBI is responsible for decommissioning unsafe buildings. The NCA Code of Conduct for the Construction Industry also stipulates the following sanctions: a. Formal warning/reprimand b. Referral to professional associations c. Issuance of fines/penalties d. Disqualification from the procurement process e. Suspension of practicing licenses f. Reporting to the National Police Service 6. Penalties and Cost Recovery Failure to comply results in penalties as prescribed by law. Property owners may incur fines or other sanctions in accordance with the Physical and Land Use Planning Act, 2019, or @ncakenya regulations. Furthermore, if demolition or corrective measures are carried out, the costs involved are recovered from the developer/property owner. Following enforcement, sites are monitored to prevent unauthorized reconstruction. However, independent site visits by @arch_ke’s Mulika Mjengo team reveal that many sites resume construction despite receiving stop-work orders. To promote safe building practices, enforcement officers from county governments, the NCA, and NBI must ensure that all construction sites comply with building regulations, prioritize public safety, and support sustainable urban development. The Multi-Sectoral Agencies Coordinating Committee (MSACC) is integral in this as it provides a multi-faceted approach towards inspections while incorporating these state agencies in the site visit team. Effective enforcement is crucial as it deters developers from circumventing the law to construct buildings that endanger lives, property, and sources of livelihoods, to reduce costs at the public's expense.

PRESS RELEASE: AAK's Statement on State House Renovations. The Architectural Association of Kenya (AAK) @Arch_KE expresses deep concern over the ongoing renovations at State House, Nairobi, which compromise its historical and architectural significance. Built in 1907 and designed by Sir Herbert Baker, State House is a neo-classical masterpiece that should be preserved, not altered. The recent renovations—changing its iconic roofing, proportions, and symmetry—diminish its historical essence. Kenya must prioritize restoration over drastic design changes to protect our heritage. AAK calls on the government to: 1.      Halt further alterations to State House. 2.      Establish clear heritage conservation guidelines. 3.      Consult heritage experts and the public in preserving national landmarks.
