I was too curious to go to bed without an answer so I looked it up. It looks like weekend days count, but since the time ends on a weekend day, it kicks it to Monday. Tuesday appears to be the earliest Bondi can request to be heard on a motion to dissolve.

I've also worked on many TROs, both on behalf of the government and in private practice, but I confess to not having read the original petition, just the order. I did not know that the court issued the order despite the failure to provide notice to the DOJ. Given that, you make another great point and I hope Bondi moves to dissolve Monday morning. Give the nature of TROs, I imagine that Saturday and Sunday count re Bondi's obligation to provide 2 days notice to the opposing party. As I practice exclusively in state courts and not federal I do not know if the question of counting weekend days towards the notice requirement has ever been addressed, or if it's already addressed in the FRCP rule dealing with calculating time.

As much as I agree with you, I am not sure one can appeal a TRO given the temporary nature of the relief granted. I suspect the argument would be that by the time SCOTUS addresses it, the show cause hearing will have taken place. I, too, am infuriated by Lawfare's ongoing abuse of the legal system and particularly with judges refusing to stop it.

I can't help but wonder how this impacts Obama's access to his presidential records. Obama has failed to surrender his records to NARA, claiming his "library" will be exclusively digital and he's still in the digitalizing process. Trump needs to formally revoke Biden's EO directing federal agencies to design GOTV plans. No one should be "registered" to vote unless he/she specifically requests it. He should also order an audit of the practices adopted by the agencies and disclose the number of registrations conducted as a result of Biden's order.
