Gutierrez was one of a handful of people who knew that Mrs. Harrison kept $600K in her home. He recruited 2 others to help rob her. DNA testing does not need to be done because Gutierrez played a major role in the crime, in that he masterminded the crime itself.

Gutierrez was convicted of the robbery-murder of Escolastica Harrison based on the fact that he MASTERMINDED the robbery. Eyewitnesses placed him in the vicinity of where the crime took place, his co-defendants said he masterminded the robbery, and Gutierrez himself says he did.

That’s for several reasons. First of all, California hasn’t executed anyone in 14 years (because their governors aren’t willing to enforce the law). Second, he’s in his 70s, so he would almost certainly have died on death row long before being executed.
