The dangerous precedent being set is allowing a judge to effectively deny a Cabinet Secretary the full authority and power to do their jobs… What department is next, if we don’t nip this in the bud NOW? State Department? Defense Department? Energy?
Common cases where ex parte orders are issued: 1. Domestic violence. 2. Child custody emergencies. 3. Stopping an illegal action. 4. To stop the destruction of evidence. 5. Fraud. 6. Bankruptcy. 7. Freezing assets. These orders require substantial proof of immediate harm. They are used for emergency purposes only. I highly doubt that allowing DOGE to view treasury files on a read only basis qualifies as any of the above. But not allowing the secretary of treasury to access treasury files is unconstitutional. I don’t like the precedent it sets when you defy a judicial ruling, but I’m just wondering what other options are these judges leaving us if they’re going to blatantly disregard the constitution for their own partisan political goals?
