They will get prosecuted for illegal discrimination, yes. But as far as the hiring process goes, companies can hire whoever they want as long as they don’t say “I hired them because they were (insert common DEI characteristic).” They can just say they hired their preferred candidate and it’s impossible to be prosecuted.
