La reciente decisión de la Tercera Sala de la Cámara Civil y Comercial de la Corte de Apelación del Distrito Nacional ha marcado un precedente significativo en el ámbito jurídico dominicano. El tribunal revocó una sentencia previa y condenó al exprocurador general de la República, Jean Alain Rodríguez Sánchez, al pago de dos millones de pesos dominicanos (RD$2,000,000.00) como indemnización por daños y perjuicios morales a favor del periodista Marino Zapete Corniel. Esta histórica sentencia, fechada el 26 de agosto de 2024, subraya la creciente importancia de la reparación por daños morales en el sistema judicial de la República Dominicana. El conflicto judicial, que comenzó con una demanda interpuesta por Zapete en 2020, se originó a raíz de publicaciones en las que Rodríguez habría incurrido en conductas que afectaron la reputación y dignidad del periodista. En el fallo, la magistrada Yokaurys Morales Castillo, presidenta del tribunal de alzada, acogió el recurso de apelación de Zapete contra la sentencia anterior, dictada en 2022, que había desestimado la compensación por daños. El recurso de apelación fue fundamentado en la argumentación de que las acciones de Rodríguez causaron un daño irreparable a la imagen pública de Zapete, constituyendo un acto de difamación y abuso de poder. I just spoke to President Volodymyr Zelenskyy of Ukraine. The conversation went very well. He, like President Putin, wants to make PEACE. We discussed a variety of topics having to do with the War, but mostly, the meeting that is being set up on Friday in Munich, where Vice President JD Vance and Secretary of State Marco Rubio will lead the Delegation. I am hopeful that the results of that meeting will be positive. It is time to stop this ridiculous War, where there has been massive, and totally unnecessary, DEATH and DESTRUCTION. When he sued HER for over $3 million for defamation, she counter sued for a symbolic $1 in a court case that took 2 YEARS for her to win. And, she did that just to show women that fighting for what's right has no price tag and to never be silent in the face of oppression. WELL IF YOU DON’T CARE BY NOW, YOU SHOULD. Because your daughters, nieces, and your nephews are watching you run your mouth. And they are seeing the world hate a woman who does so much good, simply because she exists in their line of sight. DO BETTER PEOPLE. Teach your boys to respect women. Teach your girls that as women, they are ALLOWED to take up space. Fix it. Become aware of your words. Because we all have the ability and the obligation to fight for the future of our children with simple moments. And we need to consciously choose to be better for them.
